from Savannah to three years in the peni tentiary for perjury Russell was tried in the criminal court on April 16 on a charge of bigamy preferred by Ida Hugel It was claimed that Russell had been married in Savannah Ga on the 50th of August 1S34 to Mary Hall Russell swore that he had never seen Mary Hall before the day of the trial and that he had never been in Savan nah but once in his life and then only to pass through the city He was Indicted by the grand jury for perjury The Rev Nesbit pastor of the Second Presbyterian church in Savannah swore that he had married Russell and Mary Hall on the even ing of that date in his church after a Christian Endeavor meeting He did not approve of Russell at the time and at tempted to dissuade Miss Hall from marry ing him Decatur Hl June 5 The operate railway lines on such other streets avenues and public places and upon such other route or routes as the com mon council of the city of Detroit or other prop er municipal authority may designate said grantees having the first right to construct said additional lines or routes provided they shall signify their xccejtanc of aid route or routes in writing filed with the city clerk of the city of Detroit within thirty days after the same have been lawfully designated by the proper municipal authority and due notice thereof given to said grantees their associates succes sors or The paragraph goes on to state that an exception is made in favor of the Wayne Belle Isle road and no right or option is given the Detroit Railway to operate street railways on streets now occupied by or hereafter granted tor lines of the NVayne A Belle Isle Railway Co In the petition It is set forth that the option on the street was grantej as a concession for 3 cent fares It Is also stated in another portion of the ordinance that the low fares were granted as a concession because the city paid for street paving between the tracks and because the De troit Railway was relieved ot the specific tax on its earning John Corliss and Charles lowers confidential advisers of Mayor Pingree drew up the ordinance of the Detroit Railway The Citizens' company likewise claim the op tion to the at reels of Detroit for street car pur poses by virtue of a paragraph in their ordi nance for existing franchises A soon as the Detroit Railway began laying tracks an injunc tion restraining them from so doing was asked for by the company but the Wajme Circuit Court declared such an opthm was con trary to' public policy and refused the permanent injunction The matter is now before the Su preme few minutes later While lying on the ground where he fell the murdered man suffered the most intense agony and was continually calling for his wife and chil dren McAfee lived in a little one story frame house directly in front of the Michigan Central railroad tracks After being car ried home Dr Carey was notified and at once hurried to the house but before he arrived the man was dead Dr red Clippert was also notified and the two doc tors held a post mortem examination on the remains Justice Moodie of Spring wells was also notified and at once im paneled a jury and set the inquest for Sat urday afternoon The doctors made a care ful search for the bullet but did not suc ceed in locating it until after 11 The ball entered the body between the third and fourth ribs passed through the tipper portions of both lungs and was found between the fourth and fifth ribs in his back After shooting McAfee tbe murderer walked over to the Solvay House which is run by Secord who was his companion at the time of the trouble As he passed the drug store of John Scott the latter asked him what was the trouble and he replied that he did not intend to be pounded to pieces and that he had shot McAfee in self defense He remained at the Solvay House for a short time when Constable 11 Read who had been notified arrested bim He made no resistance and was taken before Justice A Kurth where a warrant was sworn out for aasauit and battery At this time it was not known how seriously the McAfee man had been injured but the complaint was changed to murder ischer was then taken to jail McAfee was elected constable of Springwells at the spring elections but failed to qualify Tuesday however be was elected constable by tbe township board qualified and was sworn in He was about 35 yearot are heavily built and weighed about 170 pounds He was married and leaves a wife and two small children in straitened circumstances vv hen the beard crowd derer would known manv favorable things were said in ischer's behalf As stated above the murdered man was a butcher by trade but lately has been working for the firm of Carkin Stickney Cram drain age company The only actual eye witnesses to the shooting are said to be Ben Glidden John Nordstrum and the man cecord None of them would give any particulars about the affair and all made efforts to have the facts suppressed Charles ischer the murderer's brother also re fused to say anything about the case The ball which ended McAfee's life was fired front a ri ce liber revolver Constable Read has tbe re volver in his possession and took it from ischer when arrested Oscar ischer is a young man of 27 single and lives with his father and mother who have been residents of Delray for the past twelve years He is a brother of Supervisor ischer their religious cus toms and it is feared that the so called holy men are exciting the pilgrims against the Europeans lelleving that their old time privileges and profits will be swept away if the march of sanitarium is not stopped The envoys of Great Britain Russia and rance in this city are awaiting instructions from their governments in regard to the sit uation of affairs at Jiddah as well as re garding the refusal of the Turkish govern ment as exclusively cabled to the Asso ciated Press yesterday afternoon to agree to the reforms in Armenia which have been proposed by the powers In this connection the situation of affairs Is iichanged The porte's reply however is regarded as a momentary success for the military party On the other hand the policy of Turkey in this matter Is official dispatches confirming the exclusive dispatches of the Associated Press from Constantinople announcing that the Turk ish government had refused to agree to the reforms in Armenia which were de night and have assembled again at the foreign office to day There is a strong belief 1n well in formed circles here that the reply of the porte was purposely drafted in unfavorable terms in order to
