Mr Hayden's office said last night they expected the issue to be resolved with a formal hearing before the middle of this year. As many as 20 staff members of the Embassy in Indonesia were initially under investigation since the car sales racket was uncovered late last year. Three Embassy officials were brought back to Australia earlier this year to help the Department of Foreign 'Affairs with its investigations. Two methods were apparently used to beat the Indonesian regulations.

One involved using false purchase documents to circumvent the Indonesian Government's two-year no-sale regulation on duty-free vehicles imported by Embassy staff. Another method involved a-Jakarta businessman paying an Embassy staff member the amount required to import a duty-free vehicle. When the two years were up the businessman then paid an additional premium of $30,000 or more. According to; a report on the Seven network last night a total of 33 cars were purchased and disposed of by Australian Embassy officials between October 1983, when import regulations were changed, and December 1986. Almost all of these transactions were legal, according to government sources.

Under the Public Service Act the maximum penalty is dismissal if an officer is found guilty of misconduct. Under the Crimes Act such action could bring a heavy fine or a jail sentence of up to seven years. It is believed that the Australian Federal Police will now only become involved if any of the Embassy officials being investigated decide to resign. The Indonesian Government has co-operated fully with the Australian Government's inquiries because it is anxious to punish members of its own office who are believed to have been involved. Australia's relations with Indonesia have been strained since the publication of articles in The Sydney Morning Herald last year detailing the wealth of President Soeharto.

By PATRICK WALTERS and MARY LOUISE O'CALLAGHAN CANBERRA: The Federal Government is expected to take action under the Public Service Act against three Australian diplomats alleged to have been involved in a car-selling racket in Indonesia. The Minister for Foreign Affairs, Mr Hayden, decided this week to launch a formal investigation into the racket carried on at the Australian Embassy in Jakarta. Those involved in the racket were said to be making between $20,000 and $35,000 profit on the sale of cars. In a bid to smooth relations with Indonesia, Mr Hayden has rejected the advice of the Director of Public Prosecutions, Mr Ian Temby, that a prima facie case existed against the Embassy officials under the Crimes Act. Mr Hayden wants to resolve the issue as soon as possible and believes that the investigation by the Federal Police would only unduly delay proceedings.
