All the work and equipment is to be in accordance with the plans ond specifications and proposed form of contract now on file with the Secretary of the Board of Trustees in said City of Algono lowa, which by this refer- ence ore made o part hereof as though fully set out and Incorporated herein. This certified check may be cashed and the proceeds retained by the Board as agreed liquidated damages if the bidder fails to execute o contract or file on acceptable bond tor the faithful performance thereof within fourteen (14) days of- tcr the acceptance of his proposal by resolution of the Board. No bidder may withdraw a proposal for a period of fifteen (15) days after the date set for opening bids. At said hearing the Board will consider the plans and specifications and proposed form of contract for the project, the same now being on file in the office of the Secretory, reference to which Is made for a more detailed and complete description of the proposed improvements and extensions, and at said time and place the said Board will also receive and consider any objections to said plans, specifications and form of contract made by any interested party. Payment for said Improvements ond extensions will be mode pursuant to Section 397.9 to 397.19, Code of lowo, 1966 In cash from cash on hand accumulated from past net earnings of the said Municipal Waterworks and from the proceeds from the sole of Water Revenue Bonds Issued to finance the cost of the improvements. Neither the Board of Trustees nor the City of Algona, lowo, shall incur any general obligation for said improvements and extensions and the contract or contracts for the construction of said improvements and extensions shall not constitute a general obligation of the City or be payable in any monner by toxation. Payment to the contractor will be on the- basis of monthly estimates equivalent to ninety per cent (90%) of the contract value of the work completed and/or materials of a permanent nature delivered at the site of the work, during the preceding calendar month. Estimates will be prepared on the first day of each month by the contractor, and submitted to the engineer for approval, who will certify to the Board for payment each approved estimate on or before the tenth (IOth) .day ol the month in question., Such monthly payments shall In no way be ' construed as an act of acceptance for any part of the work partially or totally completed. Final payment of the remaining ten per 'cent '(10%) will be. made thirty- one (31) days after, completion of all work and acceptance thereof by resolution of the Board, subject to the coo "ditions and in accordance with.the provisions of Chapter 573'of.the Code of •Iowa, 1966. No such partial, or final payments will be due until the contractor has certified to the Board that the .materials, labor and service involved in eoch estimate have been' paid for •in accordance with the' requirements .stated in the specifications. ' ,-.T '•' The successful bidder will be required 4., to furnish a bond In an amount equal ' to one hundred per cent (100%) of the contract price, said bond to be issued by a responsible surety.and approved , by the Board and shall guarantee the faithful performance !of the; contract and-the terms >ar)d.'conditions, therein contained and shall guarantee'prompt payment for all materials! and. labor and 'protect and save harmless the City from claims and damages of any kind caused by the operations of the contractor, and shall also guarantee the work against faulty workmanship ond materials for a period of two (2) years from and after Its completion, and acceptance by the Board.- • :'•' The work under the proposed contract shall be started by April I, 1968, and all work shall be completed on or before September I; 1968, subject to any extensions of time which may be granted by the Board. The Board reserves the right to waive informalities and to reject any or all bids and to enter into such contract or contracts as it shall deem to be for its best interest. These improvements and extensions ore being constructed pursuant to authority granted the Municipality under the provisions of Chapter 397 of the Code of lowo 1966. By virtue of statutory authority, preference will be given to products ond provisions grown ana 1 coal produced within the State of lowa, and to lowa domestic labor. Plans and specifications and form of contract governing the construction of the proposed improvements and extensions, and also the prior proceedings of the Board referring to and defining said proposed improvements and exten- . sions, are hereby made a part of this notice and the proposed contract or contracts by reference and the proposed contract or contracts shall be (lewe) executed In compliance therewith.
