Two new bills covering all aspects of broadcasting and radio-communications are being drawn up this year by the Department of Post and Telecommunications. A Broadcasting Bill will replace the Broadcasting and Television Act 1942 and a Radio-communciations Bill will replace the Wireless Telegraphy Act 1905. Both Acts had become confusing with so many recent developments in broadcasting and a large number of amendments, said Mr Robert Lord, first assistant secretary of the department's broadcasting policy division. The Minister, Mr Sta-ley, has asked that the two new bills be ready for the Budget session of Parliament. Mr Mark Armstrong, a lecturer in law at the University of New South Wales, who has made a special study of broadcasting law both here and overseas, has been appointed to head the Department's legislation unit while the bills are being re-drafted.

Both bills, a recommendation of the 1976 Green Report, will be The setting up of the proposed Broadcasting Information Office (BIO) to give broadcasting information to the public, the industry and the Government, is largely the result of the work of a Melbourne lobby group. The idea was first submitted by Justice in Broadcasting to the public inquiry into the concept of self-regulation by Australian Broadcasters in February. 1977. Now. nearly two years later, legislation to incorporate" the office and its functions is being written into a new Broad-castine Bill bv officers of the Department of Post and Telecommunications.

It was intended that the office should be set up as a semi-autonomous independent body attached to the department, a Government spokesman said last week. It would probably be located in Sydney, with some representation in other S'ales. The position of director, to be advertised soon, would have the same status of autonomy as the director of the Australian Bureau of Statistics. Aside from the function its name implies, the Broadcasting Information Office will also maintain records on broadcasting stations with a limited monitoring capacity. It could be asked to research and would also receive and record complaints, referring them back to the relevant station or, if necessary, on to the Australian Broadcasting Tribunal.

The concept is not substantially different to that suggested by Justice in Broadcasting, although it was hoped the BIO would be Melbourne-based, away from the central department activity and the strong Sydney broadcasting industry lobby. "But," said Justice in Broadcasting's convenor, Mr Dirk Bakker, "the real effectiveness of a BIO is not in its structure, but in its resources and staffing. "It is the subtleties of interpretation that count" Justice in Broadcasting is a broadly based Christian group of 20 cross-professional people. Mr Bakker is a management consultant. In 1975 some of its members were part of group seeking, with 1 1 others, a public broadcasting licence.

The successful applicant was the since trouble-plagued Radio 3CR. JIB now has no association with any broad caster and exists "to ensure that the broadcasting system adequately serves the interests of all Australians." It is concerned with three major aspects of broadcasting: the legislation, the regulation and the programs and content. It operates "on the conviction that a healthy society needs open communication channels that promote a free flow of information and ideas throughout society; and that the interests of all Australians are not adequately served when limited, sectional interests, whether political, ideological. commercial or any other, control the channels of communication."
