REPUBLIC AU The Arizona Republic Wednesday. March 4, 1981 Justice OKs releasing tapes used to catch tax cheaters Fire forces 1 ,000 to flee hotel in Las Vegas; arson is blamed Associated Press Crime Republic Wire Services WASHINGTON A Supreme Court justice cleared the way Tuesday for release of secret information that the government says could help tax cheaters avoid getting caught Justice William Rehnquist refused to postpone the effect of court orders forcing the federal Bureau of Economic Analysis to release 58 computer tapes that a Bellevue, couple sued for under the Freedom of Information Act. A smoky fire at the MGM Grand in November killed 85 people and injured 704. Tuesday's blaze caused minimal damage to a basement room below the showroom stage and smoke damage to other areas of the basement, fire officials said, adding that 14 units responded to the blaze. Unlike the MGM Grand and Hilton hotels, where smoke killed most victims in upper level rooms, the Silverbird is not a high-rise resort.

Dinsman said the blaze started in a lounge used by entertainers at the resort He said the fire threatened to go up a stairwell from the basement, but sprinklers stopped it Fourteen units responded to the blaze, he said, because "you never know what you're going to find down there." LAS VEGAS, Nev. Arson was the cause of a fire that forced the evacuation Tuesday of about 1,000 casino patrons at the Silverbird Hotel on the Las Vegas Strip, fire officials said. There were no injuries. Clark County Fire Department spokesman Ralph Dinsman described the blaze as "very minor" and said it was brought under control quickly by firefighters. He said fire officials have no suspects.

"It was very suspicious in nature from the time we first arrived," Dinsman said. Arson also was blamed for a fire Feb. 10 at the Las Vegas Hilton hotel that killed eight people and injured 200 others. Former Hilton busboy Philip Cline has been charged with murder and arson in that case. heard arguments on the three commercial television networks' refusal to sell 30 minutes of prime time in December 1979 to then-President Carter, who had just announced he would seek re-election.

The Federal Communications Commission had ordered NBC, CBS and ABC to sell the time, but an appeals court stayed the directive. Four months later, the appeals court upheld the FCC, and the networks appealed to the Supreme Court Government lawyer Stephen Shapiro charged that the networks did not give Carter and other candidates "reasonable access" to the airwaves as required by the federal Communications Act But Floyd Abrams, arguing for the Restitution praised in juvenile crimes United Press International WASHINGTON The federal government's juvenile-justice experts said Tuesday that a pilot program for making juvenile offenders repay their victims instead of making them go to jail has shown remarkable effectiveness. They told a House subcommittee that: 78 percent of the 17,000 juveniles sentenced under the program successfully completed restitution without being involved in another offense. Victims recovered 87 percent of their losses. The cost of jailing a juvenile is $24,000 to $43,000 a year, but the restitution program costs only $1,000 per offender.

The testimony was offered by Douglas C. Dodge of the Justice Department's Office of Juvenile Justice and Delinquency Prevention, and Dr. Peter Schneider, of Eugene, the principal investigator of the program. Since the program began in 1978, 41 projects have been funded in 26 states, Puerto Rico and the District of Columbia. Slow Reader Catches Up In School Susan and Philip Long want information concerning the Internal Revenue Service's Taxpayer Compliance Measurement Program, supplied by the IRS to the Bureau of Economic Analysis.

The program is a statistical investigatory technique devised by the IRS to measure compliance with federal tax laws. In seeking emergency help from Rehnquist, government lawyers contended that public release of the tapes could allow "persons knowledgeable in statistical procedures and methods" to use the information "to reduce the likelihood that their returns would be audited by shifting income or deductions to other categories." Meanwhile, the Supreme Court SANDALS networks, said requiring them to sell time before they considered the campaign to be under way would reverse precedent and establish "mandatory access" for certain citizens namely politicians. The Supreme Court also decided to hear arguments on the constitutionality of an all-male military draft and draft registration later this month. The case is scheduled to be argued March 24. Last September, the U.S. Circuit Court of Appeals for the District of Columbia reversed the convictions on the ground a Supreme Court decision last June barred the use of trial evidence from government informers who shared the defendants' prison cells. The decision not to appeal the Letelier case was made by Solicitor General Wade McCree.

United Press International WASHINGTON The Justice Department has decided not to appeal a decision overturning the convictions of two anti-Castro Cubans for the murder of former Chilean Ambassador Orlando Letelier, it was disclosed Tuesday. The decision against appealing to the Supreme Court clears the way for the U.S. attorney's office in Washington to retry the two men, Guillermo Novo Sampol and Alvin Ross Diaz, for the murder of the Chilean official whose car was blown up by a bomb in 1976. "Our plan is to retry it," Robert Ogren, chief assistant U.S. attorney, said.

Letelier, a prominent official in the government of Marxist Salvador Allende, had been exiled after the overthrow of the regime in a 1973 military coup.
