and operation of privies in the City of San Saba, Texas, and area of police jurisdiction thereof; and to provide a penalty for the violation of said ordinance, or any section thereof. Be it ordained by the City Council of the City of San Saba, Texas, 1. That on or after November 1, 1931, it shall be unlawful to dispose of any human excreta within the corporate limits of the City of San Saba, except in a sanitary water flush closet or a chemical toilet or concrete vault toilet or an approved sanitary pit privy built according to the specifications of the State Department of Health, as set forth in Section 3 below; provided, that in no instance shall a toilet of either of the types enumerated be permitted within 150 feet of a water well. 2. Every building intended for human habitation or occupancy abutting on a street or alley in which there is a public sewer, or within 200 feet of a public sewer, shall bo connected with the sewer by the owner or agent of the premises in the most direct manner possible.

3. The minimum requirements of a privy are that it shall be so constructed, built, or rebuilt that: (a) The excreta deposited therein shall not fall upon the surface of the ground but enter into a pit or vault in the ground, or compartment built for the purpose. (b) The contents of said compartment vault or pit shall be inaccessible to flies, fowls, or small animals at all times. (c) -closing lids shall be provided for each unit. (d) For a pit toilet the pit shall consist of an excavated chamber conforming to the following dimensions: Minimum width inside curbing 3 feet.

Minimum length inside curbing feet. Minimum depth from ground surface 5 feet. The pit aball be provided with a box curbing, fitted closely to the sides of the pit. (e) Over the pit shall be placed a fly-tight seat which shall be ventilated by a flue extending from the pit to 8 inches above, the roof of the building and screened at the top and bottom with 16 mesh wire. 4.

The cost of installing A sanitary flush toilet and connection to the public sewer system, or the construction of a sanitary pit privy, chemical tollet, OF concrete vault privy shall be borne by the owner of the property on which the improvement is to be located. 5. All sanitary pit privies in the corporate of San Saba, Texas, shall be kept in a clean condition at all times. Self-closing lids shall be kept closed when not in use, Such pits shall be used only for the disposal of human excreta and no wash water or garbage shall be deposited therein. 6.

If any defect occur in the pit privy which would affect its sanitary conditions, the defect shall be immediately repaired. 7. All privies existing or maintained within the corporate limits of the City of San Saba, Texas, after this ordinance becomes effective which do not conform to the requirements of this ordinance shall be, and in are hereby declared a nuisance, dangerous, and a menace to public health, and the City of San Saba shall have the power and authority to abate such nuisance in accordance with the law, or in accordance with the ordinances of said City of San Saba, Texas. 8. It shall be the duty of the in health officer having jurisdiction, or his duly authorized assistant, to enter all premises as may be necessary in the enforcement of this ordinance and he is hereby so empowered.

Any person, firm or corporation who violates, refuses or fails to comply with any of the provisions of this ordinance in the corporate limits of the City of San Saba, Texas, shall be punished by fine not exceeding $100. 10. All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed. Passed and: approved Sept.

Barnett Defendant, and said petition alleging htat she and defendant were married on or about the 3rd day August 1900. and lived together as husband and wife until about the 1st day 'of August 1930, when by reason of the excesses and cruel treatment of defendant towards her they separated and have ndt lived together since and cannot do so, that during the time they lived together as man and wife, she was kind and affectionate to him and tried to make him a good wife but during the last seven years of their union defendant was cruel and abusive to her, frequently cursed her and beat and abused her called her vile names, slapped her and threatened to "beef" her and would have beaten her had it not been for the interference of their son, who interfered and told his father not to lay his hands on his mother; that defendant left her and went to West Texas, in company with another woman with whom he became enamored, and frequently before he left was out with other women on many occasions, at parties, in violation of his marriage vows to his plaintiff, to be faithful to her and that by reason of his cruel treatment of her, their further living together as husband and wife has become insupportable, Wherefore she prays that she have judgment dissolving the marriage relations existing between them, for costs of suit and for general and special relief. Herein Fail Not, and have you before said Court, at its aforesaid next regular term, this writ with your return theron, showing how you have executed the same. In fact, it would be better for the country if there were no gardens in the towns. Then the country people would have a market for about all they could grow.

Brown has returned from a week's visit with her son, H. G. Brown, in Brownwood. From Town Talk (Austin American) Published by Request Noma Philen is a plucky young Texas school teacher. She advised her pupils to stand up and fight for their rights, through a contest that went all the way to the state department.

She beat the principal, the superintendent, the local school board and the county school board. She will collect her. pay for her full contract term. She won more than money, for she won a vindication when State Supt. Marrs rebuked those who had canceled her contract and attempted to oust her from the schools.

She won the right to act like a normal, "responsible, unshackled grown-up person, All the ruckus was caused because this teacher let one of her pupils visit her. Why shouldn't she? The educational system of Texas needs some more like her. The schools need teachers and officials who will not occupy themselves meddling with the details of social life of grown and near-grown persons, instructors and students alike. Hats 'off to Miss Philen. Let her case be a starting point to recognize and honor personal responsibility, individual initiative.
