8 SATURDAY, MARCH 28, 1998 Legal aid for the poor under threat basic duty of governments to provide legal aid in criminal cases. "Legislation should not override that fundamental obligation." Professor Stephen Parker, the secretary of the Judicial Conference of Australia, said any attempt "to deny the right to a fair trial for someone charged with serious offences would be a major departure from the common consider qualifying Dietrich "to take into account the resource implications of Mr Williams has been embar-. rassed by several criminal trials being aborted because of a lack of legal aid funding. The shadow attorney-general, Senator Nick Bolkus, said Mr Williams was "trying to avoid his responsibility to provide enough legal aid to make our system bf justice "Rather than do his job he is said the move was an attempt to force the States to increase their legal aid funding. He said that if Mr Williams proceeded with his threat, Australia would to reconsider its adherence to the International Covenant on Civil and Political Rights, which "guarantees access to a defence representative for people who can't afford a The NSW Attorney-General, Mr Shaw, said: "It is a telling the vast majority of Australians who are simply too poor to be able to afford legal representation that if they are charged with a serious criminal offence they can just go rot in jail for all he cares," Senator Bolkus said.

The president of the Law Council of Australia, Mr Bret Walker, QC, said it was inconceivable that Australia's first law officer would seek to downgrade the right to a fair trial, and since it took office, leading to judges having to adjourn serious criminal trials because there is no legal aid available to finance legal representation. A spokesman for Mr Williams confirmed that the Attorney-General would ask the States to override or wind back the High Court's 1992 "Dietrich" decision, which held that unless an indigent, or needy, defendant in a serious criminal trial had access to legal repre sentation, the trial could not proceed. Mr Williams told the courts last week to be "realistic" about the Dietrich principle, provoking an outcry from the Judicial Conference of Australia, representing judges, that he was interfering in their judicial independence. Mr Williams's spokesman said the States had to consider "how much representation there should be" and that they should Circus stars in a juggling vein are not an ocean apart The paper trail out of Parer's office From Page 1 pay for it," she said. "There would be a box of 200 or so big files one day, something else another day, all sorts of things.

"Some of us thought it was not the job of MPs to be helping the Liberal Party out The general view in the office was that it was the wrong thing to do." Another former staff member, who asked not to be identified, said several Federal MPs who were approached to supply stationery refused. When Mr Jull heard of the approaches, he was sufficiently concerned to telephone the office. "David said that you just can't do that sort of the thing," the ex-staffer said. "We thought this was an awful situation to be putting Senator Parer into, but we were told that everything had been taken care of, and that we should not be making waves." Mr Jull, confirming last night that he learnt of approaches to MPs, said: "I had heard rumours and I told them it just wasn't on." Senator Parer denied through his lawyers that he had personally approved the supply of government stationery from his office to the Liberal office, but declined to comment further. Ms Nagle also declined to comment Mr Goebel said the Liberals' requirements were all purchased from a local retailer and that MPs were only approached when the party office was printing material such as labels for them.

When told of the memorandum and the claims by former staffers, Mr Goebel said: "I havent got time to talk about this. It's crap." Mr Howard's ministerial code of conduct says ministers should ensure their actions are "calculated to give the public value for its money and never abuse the privileges which, undoubtedly, are attached to ministerial The Opposition's Senate Leader, Senator John Faulkner, said the matter would be pursued at the next round of Senate estimates hearings. By MARGO KINGSTON in Canberra The right to legal representation for poor defendants charged with serious criminal offences is under threat, with the Attorney-General, Mr Williams, to ask the States to wind back or override the right in the wake of large Federal cuts to the legal aid budget The Federal Government has slashed an already stretched legal aid budget by $70 million Closer security links with NZ Australia and New Zealand have agreed to closer defence ties, including more officer exchanges and a commitment to jointly tackling the strategic effects of the Asian economic crisis. A joint communique released yesterday afternoon by Australia's Defence Minister, Mr McLachlan, and his New Zealand counterpart," Mr Max Bradford, said the two nations were to increase the ability of both defence forces to jointly respond more quickly to crises in the region. "Our two nations are for all practical purposes a single strategic entity," said the joint statement "There is no strategic partnership in our region closer than that between Australia and New Zealand.

"Bound together by geography and history, by shared values, beliefs and interests, and by the close relationships between our peoples, we have a mutual commitment to each other's security." The allies have also agreed to work closely on joint purchase strategies such as the program to replace the C-130 Hercules, and to prepare an annual assessment of the joint operations. Photo by ROBERT PEARCE By PETER COCHRANE Arts Editor It was not so much a matter of hands across the sea as hands-on at the seaside. Members of two touring circuses Circus Oz and Circus Ethiopia came together at Manly's North Steyne Beach yesterday afternoon, and the Aussie rules football was abandoned in favour of juggling clubs. The two troupes are both performing short seasons in Sydney which end tonight Circus Oz at Glen Street Theatre, Circus Ethiopia at Parramatta Riverside Theatres.

Both are well known on the international touring circuit and the respective artistic direc tors are close friends, yet the performers had not met before. For Circus Ethiopia school lessons came first yesterday, then the obligatory stop at McDonald's, before they hit the beach (although some chose to see Titanic instead). Aged between nine and 20, this troupe represents the tip of the iceberg; according to artistic director Aweke Emiru, it counts more than 600 youngsters in four Ethiopian cities as its members. Yet the circus did not exist before 1991 when, in a country which could not afford bread, let alone circuses, a Canadian teacher named Marc Lachance discovered a "creative meeting point" with Ethiopian children via his juggling. From there he founded Circus Ethiopia.

At first tentless and makeshift -the children juggled with stones, to music provided by a cassette player by 1995 it was invited to The Netherlands and the next year toured 17 European cities. This troupe will hold work- shops next week with the Flying Fruit Flies before jetting out to Europe. Circus Oz heads for Lismore, Taree, Gosford and back to Sydney for shows at Castle Hill. Asia then beckons. But for an hour or so yesterday the grind of touring was forgotten in a welter of waves and juggling clubs.
