REPUBUU CITY 1 aiuuiiu ncpuulic Thursday, February 20, mfc Senate kills bill to repeal vehicle-sales tax Suspect is EtiDOecS af fter threatening officer, police say Key lawmaker fears measure would derail ballot-initiative drive By LAURIE ROBERTS Arizona Republic Staff In an unusual, last-minute move, the state Senate on Wednesday killed a bill designed to repeal a tax on private sales of used vehicles in mid-1988. The unexpected defeat came at the hands of the Senate's chief Democrat, Minority Leader Alfredo Gutierrez of Phoenix. Gutierrez, during Wednesday's final roll-call vote, warned that it was unclear whether the Legislature, by passing the bill, would be thwarting an initiative campaign that would let voters decide in SB 1075, which would make permanent the 55-mph speed limit It passed on a 23-7 vote. SB 1101, which would designate the Rev.

Dr. Martin Luther King birthday a state holiday and would combine into Presidents' Day the two holidays set aside for George Washington and Abraham Lincoln. The vote was 17-13. The defeated tax bill, as originally drafted, would have raised to 5 percent from 4 percent the tax on the sale of used cars, boats and airplanes. SB 1102 also would have blocked the initiative drive aimed at repealing the tax.

Sen. Jeff Hill, R-Tucson, the bill's sponsor, said he brought up the measure because he feared voters would repeal the tax if given the chance, not realizing that the revenues it would raise through mid-1988 were needed to build and operate prisons. Then last week, amid much public criticism, Hill backed away from his drive to stop the initiative and amended his bill to instead repeal the tax July. 1, 1988. Hill said he worded his delayed repeal amendment so that it would not affect the initiative.

Gutierrez, however, pointed out during Wednesday's vote that legislative staff attorneys were uncertain whether the bill would affect the initiative. Attorney General Bob Corbin has been asked for an opinion on the bill's effect. Until then, Gutierrez said, the bill should be defeated. The Maricopa County attorney's office also will review the shooting, Hayes said. "He (Donahue) said he felt threatened when the gun was pointed at him," Hayes said.

The Arizona Department of Transportation vill conduct a combined location and design puolic hearing on February 27, 1966, beginning at 730 p.m. in the City of Phoenix Upper Council Chambers, 200 West Jefferson Street, Phoenix. The purpose of the hearing is to present for public discussion alternative alignments for the proposed Sky Harbor Access Road (State Route 153) between Interstate Highway 10 at 40th Street and Washington Street at 44th Street in Phoenix.

Preliminary design concepts for the six-lane urban highway will also be reviewed at the hearing. This project will feature a new bridge over the Salt River and a new entrance to Sky Harbor International Airport. The existing eastern entrance to the airport will eventually be closed when the Hohokam Expressway is replaced by a new expressway a few hundred feet to the east. New right-of-way will be required for the construction of this project. Some relocation of businesses andor residences will necessary.

State funds will be utilized for the project's construct ion. The Arizona Department of Transportation has evaluated the social, economic, and environmental impacts associated with the proposed construction of this project. These impacts and other project issues will be summarized at the hearing. Written statements received by the Department through March 10, 1986, will be given the same consideration as the public comments expressed at the hearing in reaching final decisions.
