Dinner Tonight To Col. CASE BLOWS UP Complaining Witness Fails to Appear; Attorney Charges Owen Gave Court False Name and Address Defense Attorney Charges Owen as Thiel Detective-One of Many in Arizona for Political Purposes i telephone conversation I had this morning.

I will say this I believe if I am given two days I can produce the complaining witness here. "The Court: Have you any reason to believe that Mr. Owen is in the State? "Mr. Mclver: That I can not say; I can not say whether he is here or whether he is not." The Court then recalled to Mr. Mclver the discussion had with Owen- about what his address was when the complaint was made, and the following testimony proves how Owen misled the Court "The Court: He told me Phoenix.

And when I asked him for a further address he said the Commercial Hotel; and a sobpoena was issued for him and it was learned that no man of that name had been registered at the "Commercial Hotel." To prove collusion between Owen and Papa the following is testimony: "The Court: Do you know anything to controvert the statement of the attorney for the defense that the complaining witness and this defendant were together during the evening after the warrant Was issued? "Mr. Mclver: No, I don't know what the activities of Mr. Owen were after he left, shortly after we were in the office here together. The Coui't Do you know what was done with the warrant? The warrant was handed to you and Mr. Owen.

"Mr. Mclver: The warrant was turned over to the sheriff's office. "The Court: Did you serve the warrant, Mr. Blanco? Deputy Sheriff Blanco: Yes, sir. "The Court: Was it handed to you on the evening of the 30th? Mr.

Blanco: Yes, just the day before. "The Court: Was any attempt made to serve the warrant that evening? "Mr. Blanco: No: I didn't try that evening. "The Court: When did they first show you the man or ask you to serve the warrant? Mr. Blanco: They showed me the man that night; then I served the warrant in the morning.

"The Court: The case will be dismissed. The docket entry shows the following: "Complaint dismissed on motion of defendant on account of non-appearance of complaining witness and on account of complaining witness having given to the Court either a fictitious name or of having purposely given a wrong address. When the case of Antonio Papa, alleged I. W. was called in Justice McKee's court in Maricopa County on November 2nd, the complaining witness, R.

F. Owen, failed to appear. Republican Deputy County Attorney Mclver, wearing a large camel on the lapel of his coat, and accompanied by Ralph Rollins, Republican publicity agent, and other Republican politicians, entered the court room and immediately after the case was called Mr. Mclver requested a continuance in order to find the complaining witness. The attorney for the defendant, Papa, opposed the continuance and gave as his reasons: The complaining witness in the case, who goes by the name of R.

F. Owen in the State of Arizona, is an operator for the Thiel Detective Agency in the City of Los Angeles, California. That Owen came into the City of Phoenix with the defendant Papa. He came to this court and swore out a warrant on the 30th day of October, charging the defendant with sabotage. At that time he was being escorted by other operatives of the Thiel Agency.

Several of those operators being in the State of Arizona for political purposes. That after this complaint was sworn to by R. F. Owen and the warrant placed in the hands of the sheriff Owen and Papa went to the theater together, and on the following morning Owen, the complaining witness, after carefully arranging the tables to suit himself and those whom he was representing, caused the arrest of the defendant. Deputy Sheriff Blanco, who made the arrest, testified in court that the warrant was handed to him on the evening of October 30th, and that Papa was pointed out to him that night and that he with a warrant in his pocket made no attempt to serve it Until the next morning, when he served it on Papa in front of Democratic Headquarters in the presence of Mr.

Owen, the complaining witness. The testimony proves conclusively that the complaining witness, Owens, deliberately misled the court at the time the warrant was sworn out. He informed the court that his address was at the Commercial Hotel in Phoenix, but when the constable went there to serve a subpoenae he found that Mr. Owens was not registered at the Commercial. It was further developed in the trial that Mr.

Mclver, the assistant County Attorney, did not know whether Owen was in the State now or not. Mr. Mclver informed the court that OTHER PARTIES INTERESTED IN THE CASE led him to believe that if a continuance was granted Owen would be produced. Some of the salient points in the testimony in the case follow: "The Court: Have you any reason to believe, Mr. County Attorney, that you can find Mr.

Owen, or that he will be present if you do find "Mr. Mclver: I believe so, ves. "The Court: How do you believe that? "Mr. Mclver: By talking with other parties interested in the case and- DEMOCRATIC STATE CENTRAL COMMITTEE.
