died at hiS home east of Niles to day Capt was one of the best known of the oi ler residents in this part of the state assist in the dedication ceremony This magnificent new edifice which built of stone and will have cost $16000 when ready for occupancy was designed by Clark Munger of Bay City and is in Gothic style Nine hundred loads of granite were required for the walls all of which was donated a saving of $1500 Every load of stone In the new church was solicited personally by Pastor Zimmerman who not only gave the best share of a year's time to this work but who has tolled early and late ever since the building 'operations were begun There are twenty rooms In the church including reception rooms cloak rooms toilet rooms a dining hall 26x37 kitchen and two ware rooms in the basement and auditorium chapel class rooms ladles' parlor room choir room vesti bules and hat rooms on the main floor The wood work of the church proper is of cypress finished in tho natural wood The auditorium is fifty one and one half feet square and the chapel 20x30 The two rooms can be thrown into one large audi ence room with a seating capacity of over 600 The large window on' the 'east side famous damage case of Mrs Rose Acton vs Prof rederick Partridge award ing the plaintiff the sum of $691 25 Prof Partridge has fought the case through two trials in the first' of which the jury dis agreed The whole difficulty arose over one dollar which Mrs Acton claimed the professor owed her daughter During a row over the money Partridge is alleged to have pushed the mother off of his porch injuring her wrist Mrs Acton sued for $2000 Hudson Mich March 12 (Special) Three of the four safe crackers who rob bed the morning were captured noon after a hard fight in which about fifty shots were exchanged The robbers were armed to the teeth and fought as long as there was any hope of escape They arrived on the noon train from the east and the fight was on as soon as Marshal Atkinson tried to arrest them The officers got the drop on one man at the depot and captured him while the other three fought their way out of the train shooting at every one who followed them Two more were captured about four miles from the citv by Officers Charles Winn Emmet Winn Bert Winn and Byron Goodrich Only a small amount of money was found on them One of the men cantured is wnntpi at Kalamazoo and a $200 officer were made pub lic reeman has claimed that Mosher tried to undermine him but Mosher has had the confidence of the board and the people generally and since vin dication there has been a strong fully expected to complete the college course but having while very young shown marked business) qualifica tions which had attracted the attention of Mr ord of Oneonta he was persuaded to abandon his intention and accept a po sition in the extensive mercantile house of Mr ord who was one of the most practic al and successful business men of interior New York He continued there five years giving complete satisfaction and showing great fidelity to the interests oDhis era I ployer In 18S6 he removed to Marshall and I engaged in mercantile business with Brewer This was continued until 1840 when until 1898 when he resigned and was succeeded by his son Selden Gorham If early life Mr Gorham was a Demo crat but left that partj after the campaign of 1848 and was one of the organizers of the Republican party under the oaks at Jackson In 1859 he was elected to the state senate and served one term In 1864 he was a del egate to "the Baltimore1 convention which renominated President Lincoln and in 1868 was a delegate at large to the Cincinnati convention where Gen Grant was nominat ed for he presidency In 1870 President Grant offered him the post of minister to Chili but he refused it A few months later he was appointed minister to The Hague and continued in that capacity until 1875 when he resigned and returned home Shortly afterward he became assistant sec retary of the interior the Supreme Court his brief in opposition to the application of Judge Edward Cahill for a mandamus to compel the board of state auditors to allow his claim for $250 for counseling Gov Pingree in the preparation of a taxation measure during one of the numerous spe cial sessions of the legislature The board of auditors refused to allow the claim on the ground that it was no part of the du ties of the executive to prepare bills for the legislature and that he had no more authority to employ counsel for" such a purpose at state expense than he had to write opinions for the Supreme Court The attorney general In his brief con tends that the executive has no power to employ legal counsel independent of the I attorney general except upon extraordinary circumstances which do not exist in this case He contends that the attorney gen eral was intended to be the exclusive rep resentative of the state in the courts and the legal adviser of the several state offi cers including the governor He quotes from the proceedings of the constitutional convention to prove this assertion and says it was not contemplated that any state officer should have authority to em ploy legal counsel Independent of the legal officer In this case the attorney was in no way disqualified from performing the services which Judge Cahill was employed to perforin and he was ready and willing to render the assistance required It is also contended with considerable force that the board of state auditors hav Ing passed upon the claim its determina tton is final and its acts cannot be review ed by the courts The determination of the board is said to be final for the reason that ir is a constitutional board and in passing upon the claim it was exercising its con stitutional functions Moreover it Is said tho officers have exercised their discretion on the facts which were fully Investigated and courts will not attempt to control the findings of the board under such circum stances An important contention is that the pres ent proceeding is in effect a suit agalnst the state for the collection of moneys and that it cannot be maintained for that reason as the state cannot be sued courts undertake to
