distribution by the principal receiver In asmuch as such dividends will be much larger than any dividend which might be payable solely from the hands of the Mich igan receiver They think it will be im possible for Mr Baldwin to collect all the money from the several branches in this state and account to Mr ailey for it within the time provided by the order of the Supreme Court at Indianapolis April 16 1891 Therefore the court is asked upon the payment of the money of branch 478 to direct Receiver Baldwin to pay this money over to Receiver ailey under condi tions which will preserve the rights of the petitioners in said fund The board of education Is the nominal plaintiff in a suit for the benefit of Adam Orth A Marks Nr Co the Delbridge Cameron Co and the assignee of Meyer Bros against Alexander Grant and his bondsmen James Hannon and Wendlln Springer which was begun in the XVayne Circuit Court yesterday It is alleged that Grant who had given the board of edu cation a bond in the sum of nearly $12000 for the faithful performance of his conduct to erect the Columbian school building on Merrick avenue had paid the parties for whose benefit the suit is brought only fifty cents on the dollar The remainder due them is $710 50 Grant claims that he lost money on this job and therefore could not pay his obligations The last will of the late Andrew Mc Lellan made on September 28 1877 was filed tor probate yesterday It was witnessed by Butler and 5V Thurston Black and gives the entire estate to the widow Mary A McLellan who Is named sole ex ecutrix She and Martha 55'ells McLellan the only child are the heirs at law The petition accompanying the will estimates the value of the estate at $38000 John Ritter father in law of XV in Darbe who began a suit for $10000 damages against 11 Ritter Co on riday yes terday commenced an action for the same amount of damages against Sheriff Collins and the above lirm John Ritter holds a chattel mortgage on stock which Darbe claims was partly carried away last Tuesday afternoon or evening between 2 when the sheriff gave up possession of the store and in the time Darbe claims to have been notified by a policeman that his store door was open The hearing of the case of John Connollj and others against the steambarge red Mercer was concluded in the United States Court yesterday Judge Swan held that the steambarge was to blame for the collision with the schooner Merrill which was sunk and that the tug Swain was not at fault He ordered the clerk to assess damages against the red Mercer Robert A Snodgrass has filed a bill for di vorce from Ritta Snodgrass nee Weaver to whom he was married in Ohio in Sep tember 1889 He charges desertion for more than two years Last June Otto Parlick an employe of the Detroit wooden ware was read a week before her only one and to those who still seemed to hear her voice It was Well nigh Inipwsible to accept the factr fact which the rein taut minds and hearts of her many friends found so hard of acceptance Of Mrs McMillan's characteristics a few may briefly be nient ionid She was a lover of new thoughts and bright mind The commonplace of conventional" society fell iqion a listless ear but what might be termed an Intellectual sparkle hi person or a Ixwik animated and interested her In conversation of which she underst ml not consciously perhaps but Intuitively the well bred art site always gave a certain deferential atten tion io the views of others never interrupting or checking those still speaking to the final word ye of the Training school commit tee have hud occa sional opportunity to olserve this as well as an other trait of hers when In our monthly gatherings the manifold Interests of the school conduct and general welfare came up for discussion espe cially if of more than usual interest Silently listen ing and speaking ordinarily last tlie clearness of her views Combined with a certain quiet decision in the expression of them was as noticeable as it was apt to be Convincing sincerely and deeply deplore her loss Hors was a pure and noble type of womanhood It can ill lie spared not only to the society which slie adorned but to the charities public and private to which she ministered with so kindly and gen erous a hiiiul And now our thoughts revert to the darkened home and the darkened hearts within it to the sorrowing companion of her life and the heavy hearted sons: to the ministering and loiieblngly lievot daughter in her youthful motherhood with the fresh young life nestling near her and to these bereft ones all we tender our warm sympathy ami heartfelt regrets May the solacing thought be theirs that the Len ten shadows during which she passed away have been replaced by the Easter a ness undimmed by the sadness wliiili lais over clouded
