act on the bill introduced by Representative Andrew of Massachu setts proposing more liberal legislation in behalf of national banks and a repeal of the silver bullion purchase clause of the Sherman act Representative Bacon of New York said to day that in his opinion trie committee drew bill wit 62 of Lapeer material changes in The general law is to be amended so as to protect witnesses in order that they may be compelled to testi fy The old statute of 1868 undei which the law operates is held not to be broad enough and for it must be substituted an amendment to the inter state commerce law that will give absolute protection to the witness in the matter of criminating testimony The law should be amended in the interest of other prosecutions decision of Judge Gresham is to the effect that the federal courts of the coun try cannot be required under the Constitu tion to act as aids to an administrative body in the prosecution of its work How ever the decision indicates that a law should be constitutional which provides a penal tv for refusing to testify or produce books' and that the penalty could be prose cuted in a federal court The proper reme dy thus suggested in the decision of Judge Gresham can be supplied in an amendment that has been introduced A decision made by Judge Brewer lias been taken up by other courts and made the basis for deci sions that are apparently not in harmony with the original opinion but which will be held to be until reversed and perhaps the best wav to avoid any entanglements is to amend the law at the outset The decision referred to is perhaps right in itself but the dictum makes a declaration as to what is a railroad line or what comprises a and has more or less bearing upon the con struction of the and clause This dictum is wrong and legislation is re quired to define what a line is bill the railroads are interested continued the Senator the general amendment popularly known as the bill to 1 ermit pooling It is not properly speak ing such a measure but is intended to give railways authority to make contracts be tween competing lines for the division of freight subject to approval or disapproval of the interstate commission The original Senate bill passed in 1885 had a provision authorizing the commission to investigate the question whether pooling was advisa ble and report to Congress When the measure came before the conference the House conferees insisted upon the elimina tion of the clause and Mr Reagan was es pecially persistent and refused to sign the report unless the clause was taken out This was done and the bill passed I have noticed recently that Mr Reagan has ex perienced a change of sentiment on the sub ject for I hear that he is out in a letter in which he favors the granting of authority to competing repels to make contracts for division of freight subject to approval by the Mr Cullom doe? not say whether he fa vors the pooling amendment or not but the inference is that he would be opposed to it The committee is not a unit on the amend ment for there are some members who be lieve it would be a good thing and would mitigate much of the evil now existing or matter of freight rates and would ure remedy for that discrimination which is said to be exmbited by some the trunk lines in favor of the large and against the small shipper Pratt who has occupied that position un der the
