Commissioners Blebard Tteid WHS reinstated in his former position of 'olice Sergeant This reinstatement however carried with it a auspemilon of sixty days dating from the time of his first trial a few days ago The vote stood four to one in favor of Sergt Reid Those voting in favor of reinstatement were Messrs Aust Thomas 1lowse and Hutchison Mayor Brown voted against it This action was taken after Commissioner Hutchison moved that the part of the defendant's petition referring to Mayor Brown using his personal influence against him be stricken Out This was carried Before the commission took up the work of rehearing the case Mayor Brown Chairman of the cotAmission presented a number of references handed to him by Capt Steger representing Sergt Reid The Mayor said he did not think they had any bearing on the Case at all City Attorney McAlister disagreed with him and CaptStegertaaing the floor said he Submitted them simply through courtesy to Mayor Brown JUDGMENT NOT EXECUTED Following this Attorney McAlister read his opinion that there were greunds for rehearing the case that Judgment had not been executed by Sergt Reld's successor being named Mayor Brown held that the commission had no right to reopen the case and that Sergt Red' only recourse was to take the matter to the Circuit Court With Mayor Brown dissenting the four other commissioners held that the petition Of Serge State Capitol to Church street which contemplates the condemnation of part of the property purchased by complainants for the headquarters of the Grand Lodges Complainants charke that the act of the Legielature is unconstitutional averring that one of the limitations on the Legislature is Its Inability to 1 puss a law requiring an individual or corporation to become a party to and enter into any contract It is also charged that said act is unconstitutional because it embraces more thaa one subject also because It provides that the tax of one mill shall be levied for three years it being insisted that this ties the hands of the next Legislature It le alleged that the provisions of the act would levy a tax burden for this particular purpose of $215000 when the property of the State can not reasonably cost more than $30000 or $40000 It Is also charged that it Its in violation of the provision of thb Constitution requiring taxes to be equal It is charged that the act is void because the Supreme Court has held that any enactment authorizing a municipality to levy taxes for other than corporate purposes is unauthorized and void and it is alleged to ne in violation of Section 8 of the Constitution because It applies only to the City of Nashville The city ordinance is also attacked as is the legality of of Leveral members of the Boulevard Commission to set on it Complainants
