city engineer for new walks Eighth street According to a recent survey of the city staff the present walks on the west side of Eighth street from Pine to Union streets are too far into the street and the lot lines arc alleged to encroach on the thoroughfare In some places as much as six feet Some time ago a new walk was put down In front of the Presby rian church upon the corrected line and recently stakes have been driven for newwalks south of that property to conformwith the walk lit front of the church The property owners interested will make a de termined opposition to having part of been robbed of chickens and turkeys by wholesale John rahm and John Ulrich lost turkeys this week and the theft is alleged to have been traced to Alexander ohnstfn who Is said to have sold them in DEER LICENSES Some County Clerks Liable to Get iu Trouble Over Them Grand Rapids Mich November 10 (Spe cial) Deputy Game Warden Brewster an nounces that tho county clerk of one of the northern counties is to be prosecuted criminally for official misconduct It has been discovered that several of these elerks have been issuing deer licenses illegally by selling them to non residents of the county and not from outside the state when the state law distinctly provides that residents of the state must get their licenses in the counties where they live Brewster has several of these licenses OR ALLRGED MALICIOUS PROSECUTION SAID HE MADE IN BAY CITY IN THREE DAYS Military Election Struck Coal on Jlarstonrm Bay City Mich November 10 Therewas an increase in the crowd at the Circuit Court to day to listen to the testimony giv en in the case of Edwin Bennett against John Eddy and others for damages for alleged malicious prosecution To show hoW much publicity had been given to the plain tiff at the time of his arrest articles from Bay City Detroit Chicago and other news papers were read The counsel objected to the reading of the articles but Judge Maxwell overruled the motion to strike out He said that the rule to admit such matter was pretty well defined al though it was an outrageous one Nothing was allowed excepting that which went to ishow how wide the news of the arrest was published" Bennett testified that it cost him $800 to make defense in the lice Court and that through his arrest he had lost a'position with a Boston house for which he worked in Bay City for three days when he made $365 Witness said that he endeavored to get the job of taking the school census and was told by a member of the board of education that he was not deemed a proper person because he had been arrested for embezzlement On cross examination witness detailed the formation of the Tribune Stock Company and the dis position of stock He admitted that his per sonal account with the company was over drawn 'rhe purpose of the questions the defense tvas to draw out such matters as would go to show that the defendants were justified in swearing out the warrant charging embezzlement At one point Judge Maxwell said that if he were convinced that the defendants personally sent after the plaintiff to Chicago he would direct tho jury to bring in a verdict for the plain 10 (Special) Bean the defendant in the cele brated Bean perjury case tried here in the i Circuit Court recently and Michael Orcutt i ti river driver are both in a very serious condition and will probably die as a result of swallowing a dose ot poison by mistake early this morning Bean and Orcutt were together last night and both slept at boarding place run by a Mrs'' Lucinda Showers This morning they wanted an eye opener and asked Mrs Showers for some liquor but she said she had none Bean knew of what he thought' was a bot tie of alcohol in the house and upon Mrs Showers procuring it he told her to pour it out in two glasses Bean and Orcutt both drank of the solution which proved to be I nitric acid and nitrate of mercury Dr Jackson ami A tuick were imme diately summoned but the recovery of the men seems very doubtful as the acid has eaten its way into the lining of the stom ach and inflammation has set in TESTED OR TUBERCULOSIS But Two Animals Out of Nineteen Had to' be Killed The herd of cattle belonging to A Andrews nearHaslett Park Ingham Co has just been tested for tuberculosis by II1 1 Hinds and Brown of the state sanitary commission and Dr Dumphy state veterinarian the test being completed this afternoon But two animals out of nineteen head showed any reaction from tlie tuberculosis test These were slaugh tered and the post mortem revealed tuber culosis both cows being rotten with the disease The other seventeen animals were found to be all right so far and the test lias been of Incalculable value to the own er It would be a good thing if many more farmers could secure a tuberculosis test periodically of their herds of cattle as the test is thoroughly reliable The tuberculin injected into the system has no deleterious effect whatever on healthy animals But shows a considerable rise in temperature in all animals more or less affected with the disease II AV A IN SU A NCE armer Taken in for Hundreds of Dollars Lansing Mich November armers in Leroy township it is reported here have been taken in by graveyard insurance companies to tho tune of several hundred dollars One farmer is alleged to have sunk $700 in a policy upon which if the com pany now pays the loss only $35u will be realized Tne statement Is made that sev eral other farmers have sunk so much money in the illegal business that thev have become impoverished and are in great financial distress One farmer it is al leged recently lost his homestead of eighty acres through his efforts to keep up his assessments in one of those com panies The individual whose life was in sured refused to die and after the farm was lost the wife died of grief and the old man was thus bereft ot both wife and money Valuable Autograph Letter Lansing Mich November Mrs George of this city is the possessor of some valuable autograph letters written by the early presidents of the United States Among them is a letter written in bv President Andrew Jackson to Gen Lewi's Cass acknowledging the honor conferred upon him by the territory of Michigan In naming the county ot Jackson after Another Is a letter signed by John Quincv Adams as secretary of state and another is State THREATEN TO RETALIATE STOCKHOLDERS SUED BY RECEIVER LANSING BANK Lansing Mich November 10 Receiver oster of the Savings bank whose suit to compel the stockholders to pay an assessment of 70 per cent has been on trial during the past ten days has already col lected $21000 of the $90000 which he thinks will be sufficient to pay the depositors If he obtains a decree against the stockhold ers he expects to be able to collect $22000 more which will pay the depositors about 59 cents on the dollar Some of tho stockholders who claim they were induced buy stock through misrepresentations threaten antipathy for Jackson licpublicans is deeply seated and at the recent meeting of the prison board of control he threw the harpoon into one the warden's appointments It was that of Rev Orwlck who was appointed to succeed the veteran chaplain Hickox It is extremely exceptional that the governor exercises his right to vote with the board on the confirmation of the ap pointees but the governor was present and voted nay on the proposition explaining that the only reason lie disfavored the ap pointment was because of Rev being a Jackson man Holmes of Chelsea voted with the governor and Smith and Barnes voted to confirm leaving the ap pointment in the air This is the first time in the history of the prison that the gov ernor has thus interfered with the appointments STARVED TO DEATH Y'oiing'
