The fee of two 141 a charged by the commissioner it very small for the insertion of each tract or lot of lands and made to intentionally for the purpose of inviting patronage from all sources It will by no means defray the expenses incurred by the department except by the inducements it will offer to those living in colder and more inhospitable climates and who are cultivating more unproductive soils for leaving them and immigrating to Tennessee The act creating the Bureau of Agriculture etc leaves it discretionary with the commissioner as to the language in which he may cause the books or After having done everything la the premises that an engineer can rightfully be called upon to do in the way of carefully preparing reports and supplemented communications embodying a recommendatiou together with the reasons therefor plainly- stated pointing out the irregularities lu bfds the aloseuce of deteil drawimr the subsequent Oahu of Allis to be pertnifted to guarantee higher duty than was covered by bid: in a word placing the whole matter before the commission leaving the haterpletation of bids etc to the commission where it naturally belongs there has from the first 'seemed to be an tweeconntable tendency to misinterpret and misconstrue what have written snd reeommended And now to be called there for the single and only purpose of being catechisM and cross' examined relative to a matter about Nvhieh have already written and stated an that I have to gay evinces a want of confidenee iu my sincerity that is anvthing but pleasant and I do hope that yourself and my other friends there to whom I am under so many obligations will not insist upon subjecting me to such humill'eating process If you cannot award the contract upon what I have already said yen will not be able to pass it upon anything I eau gay and this continued repetition on my part cab only place me in the unenviable and unprofessional attitude of a mere partisan working for the tiaskill engine Now I do hope you will think Of it anol of the inexcusanle position in which I should place myself by such a proeedure If the commission having my reports before them are unwilling to accept my recommendation without a rediseussion of the whole matter including the respective merits of the machinery they should call before them the respective bidders hear what they have to say and then to be my deliberate juoigment that you will hardly be able to award contract to either of the present bidders and the sooner you agree to disagree and mutually adopt some other method the better it will be for the real terests of your city This letter will reach you on 1Vednesday morning and after reading it and my last letter mailed last eventhe I do hope you will not insist upon my neglecting other and very important interests when by so doing I could do you no earthly good I leave to-night for Indianareturnihere to-morrow eveninghave an engagement here on Wednesday that I can't postpone advisable to have a special commission of gentlemen to select engines Men should be appointed in whom the public had confidence lie spoke of the danger of delay and said he thought this was the easiest solution of the matter Other members of the committee en some action of this kind and it was resolved to incorporate the suggestion in the report to the City Council TUE COMMITTEE'S REPORT The following report was agreed upon To the Mayor and City joint special com i nee appointed to investigate the charges of "undue means being used to inoluee the purchase of am engine fir the water-works of the city of Nashville" have pmeeeded to make the required investigation and respectfully submit herewith the evidence taken in the matter The oommittee are satisfied that there exist partisan feelings for the one or the other of the engines and that there hag beton corrupt eon-venation in this respect but no case of actual bribery has been proven to the satisfaction of the committee Your committee also report that in the eon- I duct of Capt Cook in this matter we find nothing to condemn and that his entire relation has been honorable anti looking to the best interest of the city In view of the complications which exist in the Water-works Commission the deadlock which that body has unfortunately for the interests of the city reached and the probable inability of the two boards composing the City Council to concur in the purchase of an engine the imminent necessity for immediate action would suggest that the whole question relating to the water-works engines and present in the matter LETTERS FROM (APT COOK Mayor Kereheval presented the following letters from Capt Cook Which were read by Judge East TOLKIon 0 April 1 A Kercheval Niavor Nashville sir: Your favor of the was received last evening and carefully noted sent you night message as requested I had arranged to visit Nashville at any time during past week if desired Hut hearing nothing horn von and seeing by public prints sent me what I expected that the investigation did not develop anything in the bribery matter worthy of note and not expecting that the cotnmittee would consider as to the merits of pump-tug machinery I have made those other appointments which will occupy my time for the next ten days: One to visit an Indiana city a visit which has already been deferred three months another In Pennsylvania and the third in New York city all of them important to others as well as to myself I have not'neglected your interests nor will I allow anything to cause me to do so Have already written and said more about your bids for pumping machinery than I ever was called upon to do elsewhere and think I can give the new committee such further views as they desire by letter as well as verbally For instate my object in reeommending three 5000000 engines instead of two of 10000000 capacity was intended to be plainly set forth in my general report last submitted it would save you an outlay of some $4000e or Val- OW without in any manlier interfering with your current supply and I should therefore consider it a useless expenditure of money My fiNt visit to your city was a hasty one Pumping machinery Wai evidently your greatest need We decided to advertise for two teu-million engines possibly without taking time tosutliciently consider the whole matter or correctly estimate the size Of the cite daily consumption etc After giving the subject more thought I did not hesitate to change former recommenda- tions in this regard when it was found to be so plainly beneficial to your interests One other reason had more or less to do with this change in this recommendation At the time of advertising for machinery It was thought that your present buildiugs could be used for the new machinery- without too much expensive reconstruction Two ten-million engines with verbal pumps could Nob-ably be placed in your present basement occupied by the Dean engines and three five-million engines could not I was not then so fully aware of your natural drainage and other charaeteristies almost imperatively necessitating the adoption of a location more remote from constant local pollution of the Cumberland As this qnestion was fully discussed in say general report it is probably needle to go all over It again here Having given my views and the reasons therefor I have only to say that my preference would have been to adhere to original recommendations had it not been for a desire to advise you against useless outlay I have no objection either personally or professionally to tho two ten-million engines if you are willing to Incur the extra cost and after having discharged my duty as I understand It I cheerfully leave the whole question with you This I believe is the only question given In your letter about which the committee desire a conference with me If they desire as you say to "examine Into the character of the machinery" I do not just see how it eau be done In Nashville If they desire information additional to what has already been said and written It would seem desirable to have them visit other cities and examine machinery in serviee As I have before stated to you verbally and repeatedly as well as in written report both the engines under immediate consideration are more or less experimental tho one entirely so and I therefore inserted unusual safeguards In the contract for the protection of your interests Having failed to secure the main object which impelled me to recommend that all original bids be rejected the Meuring of more bids and for machinery having prestige of actual success we were left to decide upon what we did receive and while I still believe that the engine recommended wonld prove a safe and durable reliance and while I have studiously and Conscientiously avoided saying or writing anything derogatory to the Allis engine but hasing my recommendation wholly upon commercial value as measured by the duty guarantee you might possibly reach an miler and more gener ally satisfactory solution of this troubions (mess tion by again opening the whole question to competition Yon are now evidently at a deeds lock and with determined partisans on both side the Lord only- knows how -long it may continue leaving your eity in the 'meantime on the threshold of a water famine and subject to danger from conflagrations The lines are already so tightly drawn the excitement so ins tense and antagonism so deep-seated that the advice of an engineer is wholly ignored or Unkindly triticised and should either engine be adopted it must be by a bare majority with an and persistent minority ever ready to interpose obstacles and impedimenta to an extent that would in all probability Jeopardize the interests of the contractor I will not atterapt thedifficult task of advising as the matter has already gone beyond the purview of an engineer's duty Am ready to do anything in my power to secure you more harmonious action have
