declared that the econ omy is out of control Executive clients of Rinfret Boston Associates were mailed this week a two page summary detailing his disaffection with Phase 3 policies which he said nobody really understands is deteriorat ing" he said and wide spread and common impression is that the economy is out of He added: looks as if disorder may be about to reign While confusion is growing and confidence is deteriorating about domestic policies he said confusion about the international situation is even Regarding monetary matters he said are confused and concerned about the Amer ican the eco nomic theorists are back in control When John Connally was secreary of Treasury there was a hard hitting clear cut set of pragmatic economic policies which was evolved and He said they ask your advice they pose a hypo thesis to you and when you agree to it you turn around and they've changed The ad ministration calls Phase 3 vol untary he said then says it Claiming a communications problem exists he told clients: one is quie sure justwhat Phase 3 is all about Nei ther the price standards nor the wage standards are understood The posture of labor is totally unclear Inflation is By President WASHINGTON (AP) At least 10 earlier presidents have clashed with Congress over ex ecutive privilege a controversy almost as old as the and one in which President Nixon has invited a Supreme Court test The issue is wheher it is the right of a president to deny Congress access to the testi mony or papers of executive branch officials The controversy has reached the courts before but there never has been a definitive de cision Nixon said it may be the time to get one Nixon has refused to send his legal counsel John W' Dean III to testify before the Senate Judiciary Committee which is considering the nomination of Patrick Gray III as BI di rector the Senate feels they want a court test we would welcome the President told a news conference Thursday Nixon has ample precedent for his insistence on executive privilege The privilege doctrine was in voked by the first president George Washington Others who relied on it were Thomas Jef ferson Andrew Jackson John Tyler Ulysses Grant Grover Cleveland William Howard Taft Herbert Hoover ranklin Roosevelt and Dwight Eisenhower In 1796 Washington refused to turn over to the House corre spondence and other documents and instructions given to John Jay in connection with a treaty with England Washington's po sition was that the material was not to any pur pose under the cognizance of the House When the House adopted a resolution insisting that it had a right to the information Wash ington was defended by James Madison later to become presi dent Washington gave some of the data to the Senate but not the House for use during con sideration of the treaty Jefferson got into the privi lege controversy in 1807 during the trial of Aaron Burr for trea son Burr subpoenaed a letter written to Jefferson by Gen James Wilkinson Jefferson claimed the letter was private and probably involved the na tional safety He finally agreed to let government counsel with hold parts of the letter not directly material for purposes of justice Chief Justice Marshall ruled that privilege does exist to withhold private letters of a certain it is a very serious he added such a let ter should contain any informa tion President Jackson for a copy of instructions he reportedly read at a Cabinet meeting regarding withdrawal of funds from the United States Bank Jackson refused saying there was no constitutional authority for the Senate require of me an ac count of any communication either verbally or in writing made to the heads of depart ments acting as a Cabinet Jackson also refused to in form the Senate of charges if any against the official con duct of Gideon itz whom Jackson removed as surveyor general south of the state of Tennessee It was none of the Senate's concern Jackson con tended because in such cases the president has exclusive power of removal from office The House clashed with Pres ident Tyler in 1842 over a re quest for names of congress men who had applied for feder al office Tyler refused the re quest as an invasion of the ex jurisdiction In 1843 Tyler refused to give the House information it re quested about alleged frauds by Indian agents The House adopted a strongly worded res olution demanding the informa tion and Tyler provided some but not all of it Grant's run in also was with the House which in 1876 want ed to know if any executive acts had been performed at a
