court law will immedi ately be carried to the supreme court At the conclusion of the hearing on the order to show cause yesterday why Police Justice Stein should not be mandamused to conduct examina tions into juvenile complaints the circuit judges announced that the wiit will be issued The hearing before the full bench of the Wayne circuit court was on two separate actions Contending that the law is constitutional Prosecuting At torney' Hunt petitioned the circuit court to appoint one of their number to hear juvenile complaints as called for by the new law The second action was brought by Police Commissioner Whelan through his attorney red Warren to se cure a writ of mandamus to compel Police Justice Stein to entertain juve nile complaints Prosecutor Hunt argued that a great deal of the confusion resulting from the passage of the new law is due to the attempt to place juvenile offend ers in the same category with crim inals The new law he argued is not a criminal but a reformatory law Mr Warren contended that the law is inconsistent and unconstitutional in that it sweeps aside in juvenile cases ail criminal procedure The matter will be carried 'to supreme court under certiorari ceedings by Police Justice Stein At the in the case of Douglas vs the Pere Marquette railway the plaintiff was given a verdict for $1125 While in the employ of the company he was in jured while using a hoist and claims' the injuries have permanently disabled him for work Evidence was taken In the suit of George Holmes against the Sandwich Windsor Amherstburg Electric rail way for said Sinclair the coal dealer yes terday situation is he went on April the shippers get their lowest price which they advance to the retailer each month Coal Is now costing the retailer 50 cents a ton more than it did in April so that the retail dealer must advance the price When this is done the retailer will be in the same relative position as to profits that he was in last April People often ask us why we buy all our coal for the year in April when the price is lowest The reas on is that the shipper is supreme and will not fill such an order The ship pers distribute their product just as it suits them sending a small portion of lot ordered They refuse to guar antee the price at any time 1 far as a strike' is concerned there are indications that one may take place next April when the state hospital hasL escaped from that institution Holstein was found unconscious in I Delaware park the night of "June 2 It was at first supposed he had been assaulted by robbers but it found that his skull had frac tured some years before and had been operated on and as there was no fresh injury the conclusion was reached he was suffering from epi lepsy resulting from the old injury He remained unconscious for hours When he came to ne identified him self as Jonn Holstein a mechanical draftsman of Brooklyn He had been picked up under similar circumstances in Detroit and had been under treat ment in a Detroit hospital for six months While in the Detroit hospital where he had described himself as George Gibbs a baker he had shown by some clever specimens that he was an expert mechanical" draftsman He also quoted passages from the Koran and spoke and wrote in foreign languages Careful treatment and study of his case went on and it was hoped event ually that he would be able to recall his true identity which may le neither Gibbs nor Holstein Mean while the physicians made inquiries at New York Brooklyn and elsewhere in the hope of finding his friends A few weeks ago his general condition had po improved that he was allowed parole That is he was given the privilege to walk about the asylum grounds without attendance He seemed to have no intention or desire to escape One morning after break fast he went out on the grounds with some other paroled patients They separated 'and no one noticed which way Holstein went Gibbs was found in the rear of theParisian laundry on the night of Sep tember 14 1904 and was at Grace hospital for several weeks He was later transferred to the asylum at Eloise and ultimately discharged' Gibbs went to work in the bakery of Leopold Kull 727 Gratiot avenue in Mar but disappeared about June 1 Dr Marker in charge of the county house gave the opinion that Gibbs was a man who was trying to hide his identity mentioned the gun with os Jro
