Commissioners In session yesterday and today in Washington to hear argument for and against its proposed uniform code of demurrage rules Henry Dowling a member of the Railroad Commission of Indiana has submitted a brief of a num ber of changes In the demurrage rules which he thinks should be made in the proposed code Judge Dowling is a mem ber of the General "Committee of which Commissioner ranklin Lane of the Interstate Commerce Commission is head This commute was appointed by the national association to draft the uniform code At the first meeting of the full committee a subcommittee The mine or coke oven proprietors will in this way be placed upon an equal i footing ree Time Proposed Regarding the free time allowed the code proposes forty eight hours free time for loading or unloading on all commodi ties Commissioner Dowling proposes that this shall not apply when the car is moved without charge to any track or siding on the initial line for the accommodation of the consignee or consignor On such cars time shall be completed from the original placing It is also proposed that cars containing freight in bond (whisky) shall be allowed forty eight free time for unloading computing from the first 7 a after the permit is issued to the consignee by the United States collector of customs provided the con signee arranges with the latter for his official release of cars within forty eight hours after the first 7 a after arrival Where such arrangements are effected within that time the time consumed in excess shall be added to the time con Burned in unloading and demurrage charged as provided in the rules Un Jess this modification is inserted the con signee may wait indefinitely to secure the release i'' In regard to notice being served uponthe consignee of a arrival it is proposed that telephone notice where agreeable to both carrier and shipper shall be legal The rules as drawn pro vide only for mall notices Treatment of reight Where a oar is to be benefit ofthe men weather too cold or for some ether reason too inclement to permit the handling of freight without injury to men shall be an exception Iron ore for i example In extreme cold weather the local car service manager If his de cision is unsatisfactory It can be appealed to the division superintendent or other official of the road whose decision will be final In the meantime the penalties shall not be enforced The average demurrage is deemed un just by Commissioner Dowling The av erage demurrage rule has been that credit be given to the shipper who unloads or loads in less than forty eight hours or example if one car is unloaded in twenty fonr hours the time is allowed on a sec i ond car making the allowance for the sec ond car seventy two hours This rule elves all the
