Exhausted Exhaust iiiiiiiiiiiiiiiiiiiiiiiniii Photos Decide Fence Dispute 'An 11-month-old Circuit Court decision was reversed Friday on the strength of some old aerial photographs which were entered as new evidence in a land dispute between two farmers. Clinton Attorney Jacob Geffs won from Judge Arthur Luebke a reversal of a decision against his client which was made in Circuit Court Feb. 28, 1969. The original case involved a fence dispute between Geffs clients, John P. Prezak and his wife, Lydia, and Leonard 0.

Linden and his wife. Geffs initial complaint had charged Linden with building a fence in May, 1968, which was not on the. old fence (hence property) line, but extended into Prezak's land. The fence ran from north to south to Tighe Road in Clinton Township. The decision on the property line went against the Prezaks last February.

The Linden's attorney is Marshall W. Robson, Beloit. However, the case remained open and Friday Geffs presented new evidence in the form of 1966 aerial photographs of the area which established that the fence line was moved into the Prezak land by Linden. Judge Luebke reversed his earlier decision and today signed a judgment which orders Linden to move 658 feet of fence to the old property line. The court found the fence was 18 feet out of line at the south end and 7 feet, 5 inches off at the northsend.

The court ruled the fence must be moved by April 1 and that the Prezaks provide one-half the labor in its removal. The court further said "all parties are restrained and enjoined from resorting to physical violence or the threat of physical violence."
