CAPT ORTON SAYS HE YELLED AT THEM Tried to Turn His Boat Aside but in Vain Battle Creek Mich August A jury has been summoned by Justice Merritt in the absence of Coroner Robertson' and an inquest will be held next Wednesday on' the death of the live persons drowned at Lake Goguac last night Miss Carrie yoqk of Johnstown Pa the only one of the party saved is resting quite comfort ably to day having somewhat recov ered from the awful shock produced by the experiences of last night All of the party were of the Seventh Day Adventist denomination and were with the exception of Miss Richards members of the new class in the training school at the 'sani tarium None of them had been here over eight weeks Miss Richards came here from Traverse City where she gave up a position with a city official to take a similar position as stenographer with the Sanitarium ood Co so that she could be near the headquarters of the denomination to which she belonged young lady escaped the fate of the others by not being op time the party leaving without her The party had been out for a row on the lake and were returning to the dock of the sanitarium villa but evidently made a mistake In the di rection got changed about in the darkness and were rowing toward Waupakisco beach The steamer struck the boat souare in the center and it turned bottom side up When the boat went over a shawl fell over the face of Miss yock and prevent ed the water from getting in her mouth and nostrils As she went down she grabbed the side of the boat swung out from under it and freeing herself from the shawl pulled herself half way up on the bottom of the boat where a man in a rowboat found her clinging for life and res cued her She states that not one of the party saw the approaching steam er until it crashed into the rowboat Capt Orton of the steamer Wel come has sailed upon the lakes all of his life until a few years ago when he retired He has held a master's license since he was 19 years of age and this is the first accident that he ever had in all these years All the side lights on the boats were lighted as were a big lantern in front of the engine house another on the stern and several around the sides When he saw the boat it was being rowed right across his path He yelled to them to stop rowing and stand still They evidently did not hear him and so he threw the wheel over so as to throw his boat to the right and away from them but notwithstanding all of this endeavor it struck the boat The steamer had on board a party of 130 colored people out for an even ing excursion Deputy Sheriff Elliott has the past week Battle Creek has been reveling in a sensation that is the talk of the town Chauncey Hodges' gam bling place was pulled and with the proprietor were arrested eleven per sons now claimed to be prominent cit izens They were before Justice Robinson just before midnight fined all giving fictitious names The arrest was made upon complaint of Mrs Sarah Kelley of Chicago Her hus band was a switchman and got hurt in the discharge of his duties and re cently settled with the company for $800 and then came down to Battle Creek to have a good time and spend the money which he succeeded in do ing His wife followed him here and claimed that he had lost a part of the money in gambling houses and made the complaint against Hodges This was followed by the arrest and fining of Ed Murphey the proprietor of an other gambling joint It is now claimed that the eleven men who were arrested were not only prominent citizens but among the number was a city official and a former ex city official This claim is made by Aid Harry Haak who is under arrest charged with swindling the city out of 11500 by overcharging his lumber bills Haak Is publicly telling about the streets who the arrested men are supposed to be and his alleged disclosure is caus ing ro end of talk' He has introduced a resolution in the common council de manding that all justices of the peace who have had cases under the city ordinances report at once those cases to the council and the true names of the parties arrested He did this to get the names in the official proceed ings of the council The council voted to lay the resolution over until the next meeting when it will probably be defeated The outcome is awaited with great interest EVANGELICAL LUTHERAN SYNOD AT ALBION Albion Mich August 28 The an nual convention of the Evangelical Lutheran synod of Michigan and other states began its six day session here to day About forty ministers and thirty lay delegates have already ar rived and more are expected The opening service was held this morning in the German Lutheran church and was conducted by Rev Bedamner of Toledo At 2 o'clock this afternoon the re port of Rev Mr Bedamner president of the stranger walk ed into jewelry store and looked over some watches He said that he not be suited but after he had gone it was discovered that he had done the sleight cf hand act for a $10 timepiece Two hours 'later he attempted the same preformance at Haller's jewelry store Mr Haller caught him in the disappearance act and obliged him to drop a $14 50 Ucktr out of his sleeve Mr foxy act caused the fellow to do a hasty exit Mr Haller immediately notified the other jewelry stores to watch out for the thief and sent two clerks to trail nlm Mr napman responded quickly and personally caught the fel Jones living about two miles west of this place commit ted suicide this afternoon by firing a charge of buckshot into his neek from a heavily loaded shotgun The cause of this terrible act is Supposed Saturday from his lata hbme near that village Mr Ball was born in Niles N' on April 7 1830 He came to Webster Washtenaw county with his father in 1836 In 1858 he purchased in Hamburg 147 acres which comprise a portion of his present 509 acre farm He was leading farmer of the state and was presi dent of the Hichigan Sheep Breeders' and Wool Association for a number of years As a breeder of short horns and Spanish merinos he was well known He joined the Republican party at its birth In 1863 he was supervisor of Hamburg In 1864 and 1866 he was elect ed to the Michigan legislature and in the he was made state senator He was elected president pro tern of that body and upon the death of the lieutenant governor was made the acting officer He has always been prominent in the councils of the new medical registration law has worked a hardship Ono instance has recent ly been brought to the attention of the attorney general A prominent physician of fifteen experience who has built up an extensive prac tice in a northern Michigan town and who has many cures to his credit was a graduate of a school not recognized by the board of state medical ex aminers and he was required to take the examination He passed a greater portion of the branches in which he was examined with good credit marks standing per cent in chemistry but on the whole he failed to pass He has therefore been denied a REORES TRATION ADVANCED Delegates Have Started on Their Northern Trip ANSING Mich August The National orestry Association concluded its sessions here this afternoon and left on' the'' 6 o'clock train for Roscommon where the forestry experts and scientists present at the meeting will visit the state forestry reserve under the chap eronage of Land Commissioner Wildey President Garfield of the state com mission and Hon Arthur Hill of Saginaw After a day spent in the desolate country of themiddle north the company will proceed to Mackinac island for a day or two There were about thirty members of the party which lett the city this evening To day rank Miller of the Unit ed States bureau of forestry read a paper on arm which was followed by an interesting discus sion by Hon George Horton mas ter of the state grange In Mr Mil opinion the planting of forest trees for protection and ornament is commendable but too much planting has been done he thought with those objects In view Too little attention has been paid to planting for profit and to this omission is frequently due a failure to attain fully the other two objects mentioned A well kept wood lot is not only a source of revenue in the posts cordwood and materials for farm repairs it furnishes but it gives character and adds beauty to the home The appreciating prices of the products of the woodlot the ease with which such a plantation lends Itself to rational management and the Increas ing Interest in timber culture all ar gue In favor of extensive commercial planting Master Horton has one of the few pieces of original forests existing in southern Michigan and be exhibited pictures of a grand oak twenty four feet in circumference which is still growing on his farm He is an ad vocate of a law exempting forest pre serves on agricultural lands from taxation Thomas Sherrord gave a good paper on the orest Pre An estimate was given of the possible production of a second crop of timber on these lands An organ ization was recommended for the prac tical management of the preserve which it was estimated would cost $3000 a year or five cents per acre The prime necessity for the mainten ance of a fire service during danger ous seasons was urged Mr Sherrord has practical knowledge of the condi tions existing on the forestry pre serve and bls' address was one of the most valuable of the meeting Walter Winchester of Grand Rapids spoke as a practical lumber man on Michigan 'hardwood forests He described the conditions at present and reviewed the operations of the lumber industries lum berman buying timber lands to said Mr Winchester is naturally not in sympathy with the principles of All the products of the forest are utilized even the ferns growing in the timber are picked and sold in the Chicago market to florists In Mr view' the taxes on timber lands are very high and some remedy must be found in the way of a rebate of taxes to persons who are willing to hold their lands after cutting off the mature timber In his opinion the undergrowth which springs up very rapidly on hemlock and cedar lands will keep the ground from drying out The protection of trees of fifty years' growth and under is necessary to preserve large areas of hardwood lands for a new crop The enactment of taxation laws was urged with this object in view which would make it a business propositiou Chippewa orest Reservation was the title of a paper by Herman Chapman superintend ent of the State Experiment farm at Grand 'Rapids Minn Mr Chapman outlined the forest conditions existing in Minnesota which led to the recent action of congress in establishing the Chippewa forest reserve One third of the state of Minnnesota is pine land which has been cut over A great por tion of it is unfit for farming and the problem for determination is what shall be done with it? The difficulties in the way of forest reproduction on lands long cut over and abandoned to fires and brush were set forth Mr Chapman held that practical! steps should be taken at the time of cut ting the pine Reforesting should be directeo either by state or national authority and in Minnesota the best opportunity lay in the direction of na tional control The recent bill provides for a forest reserve of 200000 acres to ba under the control of the chief of the bureau of forestry in the United States department of agriculture who shall regulate the cutting of the timber save seed trees and protect from fire Mr Chapman expressed the belief that under wise administration of this ftieasure the pine may be perpetualiy renewed on this tract Action Commentlrd The following resolutions were adopted: That this convention of the American orestry Association heartily commends the action of the state of Michigan in establishing a forest reserve in Roscommon and Crawford counties at the head waters of the principal rivers of thelower peninsula rom data based upon criti cal and scientific Inspection of the ter ritory having regard to soil climate' and past and present tree growth pre sented to us by national and state experts the conclusion is reached that the Michigan forest reserve lands are i generally of small agricultural value but a especially to the growth of pine and certain other trees which flourish on sanffy soil The cre ation of a permanent forest cover for that region will preserve and regulate the water supply of the outflowing riv ers will furnish shelter for our fast diminishing game and there will be found great sanitarium to which the people may go for rest and healing and finally when the forest becomes fairly grown it will con produce a substantial revenue and become eventually a profitable financial investment for the state" Gov Btfaa Against orest Re serves This afternoon there was a general discussion under the leadership of Ar thur Hill of Saginaw of the duty of state in forest matters Among acse who spoke on this subject was Gov Bliss who expressed the opinionhat it would be unwise to reserve vast tracts of land for this is now ex hausted and before the next tax money will be available the city will owe the lighting company nearly $4 000 Last year $6000 was appropriated to lighting fund The cost of lisnt ing is over $7000 per year and the Aid ermen take the position that if this deficit and appropriation was all taken up at once it would mean a consider able increase in the city tax rate or the robbing of the other funds They say the municipal' ownership Idea will be submitted at the spring election If it carries there will then be ample time to secure estimates construct a plant sell the bonds at the best price and get into such shape that the Stan dard Lighting company will npt: have the city on the hip as in the present situation Will Have a Hospital The women of the city who are working on the project for a city hospital have made arrangements to make: a practical demonstration of hospital work at the state fair They will have a tent equipped with hos pital facilities and will care for all who may suffer from sickness or ac cidents Outlook lor State air A Secretary Butterfield of the state fair association states that the out look for the fair this year is even bet ter than it was a year ago In sev eral departments more space has been sold already than altogether last year There will be more and better attractions than a year ago and every precaution has been taken to provide transportation for the throngs of peo ple who are expected The state fish commission will make an exhibit A lot of brook trout were sent out to the water works where they were kept several days in the
