in Mr favor The case is a somewhat peculiar one and it Is claimed the suit caused Mr Uhl a great deal of annoyance and worry in the" last months of his life He became in August 1879 assignee of Ichabod Quimby who had lia bilities of $41000' and his assets con sisted of rnill and surroundings in Grand IlapidsAand some other proper ty the whole of which would not have sold for the amount of (he liabilities Mr Uhl took 'hold of the business and instead of selling the property and paying the debts as he should probably have done proceeded to op erate the mill giving his personal ob carried on the business in a way not strictly authorized by the au thority conferred upon him yet hav ing acted in good faith and vith their assent they cannot select those years in which ho made a George Nichols who is defend ant in a proceeding for contempt of court? growing out of his defense of Attorney Salsbury of Grand Rapids and his alleged attempt to bribe a wit ness was denied relief by the Supreme Court this afternoon Nichols asked for a writ uf prohibition to restrain Judge Newnham from proceeding with the case against him Judge Grant in his opinion holds that while the writ of prohibition is the proper remedy the judge of the Superior Court has the necessary power to punish for con tempt of court even though such power is not expressly given by the act establishing the Superior Court One question 7 discussed at length is whether Circuit Courts in this state inherent power to punish for con tempt the court deciding that as the judicial department must be absolute ly independent of the legislative de partment the courts of record estab lished by the constitution are clothed with the exclusive power over con tempts a power which has existed from time immemorial
