court sustained the witness in his declination and counsel for the plaintiff ex cepted The witness subsequently explained that what he had in his mind in declining to answer was the civil suit now pending against him Mr I understand that the Witness no longer claims the privilege Court judge so from his last IMr your Honor the wit ness does not Mr Lothrop may It please the court we cannot stop to give this man a le gal Mr Griffin (to witness) did Ross I do when he asked you for the bill Witness said there had been a bill filed and asked me if it contained charges ot adultery against Judge Reilly I sold the bill was in court and could be seen there lie then asked me if this thing happen in the office and I replied that Robbins Would swear to something as strong as that I told him that if he simply wanted to announce that there had been such a bill filed he might do so but cautioned him not to mention my nameor Judge Mr you communicate to the reporter anything more than that you have stated I gave him something of history and told how he had been swindled out of his money through the duet of his Mr day of the week Witness and the bill was on the previous Mr hour was it that you saw Ross Witness 9 and 12 On redirect examination by Judge Crofoot Mr Galloway testified that before the th of December he had no acquaintance with Mr Scripps or any other person connected with his paper CAMILLE BOBBINS Was the next witness He testified that he knew Mr Galloway had employed him to do business for him he had no objection to Mr Galloway testifying in this case regarding hiswlfe Witness was not cross examined JAMES The defendant was then called Ha testified that he was connected with the paper in which the libel was published and thvt the price of the paper was two cents The question as to what pecuniary interest In the concern was was objected to but allowed by the court Witness owned a two thlrd Interest The first Impression of the paper is published at 2 witness looked after the editorial telegraph State news correspondence" and matter of that kind called the general department In December 1875 Mr Dee was city editor The busiest hour of I the day was just before going to press He had no knowledge ofthe libelous article before it was pubiisuea on tue uay of ita publication he was busy abstracting the message He had no per sonal acquaintance with Judge Keuly prior to the th of December and had no malice or ill feeling toward him Cross examined by Mr Griffin Began to get the message about 3 on the 7th of December printed a portion of it that dav: the article in regard to the plaintiff was published in both editions of his paper i Mr Griffin drew the attention of the jury to the fact that the portion of the President message printed was referring to Mr "Reilly next day when presented to him in the writ He presumed he exer cised his usual care in looking over the issue of the Sth of December Mr felt it Incumbent upon 'you to look over UI SKYMAN 88 Griswold st The trial of the case of Judge Reilly against James Scripps for libel was re sumed in the Superior Court yesterday Judge Cochrane presiding Mr Griffin for the plaintiff put in evi dence the libelous article and offered the let ter mentioned in the report of proceedings a letter addressed to Judge Reilly by the father of a young lady with whom he was on visiting terms giving him the cut direct This was objected toby counsel and the court ruled it out Next the plaintiff offered in testimony an article in paper of December 8 (the day the publication of the libel upon which the present action is brought) headed Libel Suit udge Reilly is Dissatisfied with the Proceedings of the Superior Court and Instead of Going to Judge "Cochrane Picks a Quarrel This was objected to but the objection was overruled and an exception was taken Then followed an article of December 9 headed Reilly Slashing Around for and containing a contemptuous reference to Con An article coupling the names of Judge Reilly and George Penniman in a like contemp tuous manner was ruled out The next item of testimony was a paragraph stating that contestants in the Ward will case are still adding to their corps of lawyers They have lately retained Levi Griffin and Don Dlckinson These two gentlemen occupy the same suite of rooms that his Honor Judge Reilly This Mr Griffin said he interpreted as an imputation upon Judge Reilly and he thought the jury would also interpret it in that light It was admitted and read to the jury Another paragraph was read in which mention is made of small ring of Detroit lawyers having entered into a con etc and of Judge Reilly allow ing himself to be used by them as a figure The last of these extracts wasIiead ed Contemptible and bore reference to the criminal action against Scrimps instituted at the complaint of Judge Reilly In this connection Mr Griffin offered to prove that Logan Chipman who was also mentioned In the article as one of Judge Reilly's advisers knew nothing about the proceedings against Scripps until after they had been commenced Judge Cochrane said it was not and no effort was made to press the offer The plaintiff then rested and the DEENSE WAS BEGUN Mr Crofoot first offered certified copies of the original bill the amended bill and the answer in the divorce case of Robbins va Robbins Judge Coshrane said that the originals of those documents were in the court room whereupon they were substituted for the certified copies Mr Griffin objected to their admis sion on the grounds that they were not a part of the record from which it follows that the libel complained of is not matter also that the bill furnishes no evidence that it was the source of information when he published the libelous article as It does not appear that it was on file at that time Judge Cochrane said that although the record does not show that it was as a matter of fact on file at the time of the publication I complained of He sustained Mr objection however The defense then ot tered the same documenta in mitigation of damages and they were admitted on that ground Then followed an argument by Mr Loth rop and Mr Crofoot as to what constitutes and at the conclusion of the arguments JOHN GALLOWAY The solicitor who drew the Robbins bill was called to the witness stand He testified that Camille Robbins communicated to him the facta upon which both the origi nal and amended bills were drafted I Mr Crofoot asked the witness if Robbins related to him the facts upon which the adultery clause was inserted in the bill Mr Griffin objected to Mr Galloway Answering that on the" grounds that it was immaterial and Irrelevant and for the urth er reason that being a communication from client to attorney it was privileged and'Mr Galloway had no right to disclose it without i Mr Robbins waiving his privilege The objection was overruled and the wit ness answered He then went on to state that the first time he had a consultation with Robbins the lat ter told him that he had caught his wife and Judge Reilly in the act charged in the bill that he (Robbins) insisted upon incorporating that in the bill against his advice to proceed simply on the grounds of desertion ana fraud The defenee then offered to projre by thia witness that Robbins had released him from any professional obligation of secrscy and consented to his testifying to whatever took place between them Judge Cochrane ruled that they must I show that release or waiver by the client himself The objection was subsequently withdrawn however and Mr Gallo way
