That the Cireuit Judge had covered the same ground substantially and made tbe proper discriminations in his charge whichwas fair to want tbe defendants and intended to bo full and this was probably the reason of his refusal to grant the requests preferred If there was anything objectionable about tho charge as given it consisted in it not guardingtliedcfendanlGregg as carefully as it did the defendant Saunders But as hn laid the principle of law correctly it can hardly be conceived that the jury would fall to ap ply it to Hie ease ot one defendant when ex pressly told to apply it to the other No notice was taken of the omission at the time and there is no reason to suppose the parties then lieliovcd this omission was preju dicial and Gregg should not be heard to complain now There is not the same danger of misleading the jury by refusing to grant proper requests to charge when the same ground is covered by the charge as given under our present practice which is to sub mit requests against Ballard in a justice's court to recover the amount of a United States Government draft of A73 drawn upon the Assistant Treas urer at New York in favor of the firm of Has call A Ballard (composed of plaintiff and de fendant who had been partners when the claim against the government accrued) The partnership was dissolved about a year licfore the draft was issued and upon the dissolu tion Ballard had assigned and transferred to Hascall all the property claims and assets of the firm of which the claim against the gov ernment was a part Hascall in the same in strument assuming all the debts and liabili ties of the linn and agreeing to indemnify Bal lard thereform The draft was scut by the government to a deputy ebllector at Kalama zoo and wiii by him delivered to Ballard who gave a receipt for the same in tlie name of the firm and who afterward negotiated it and it was cashed at the bank 1 1 asea 1 1 re covered judgment licfore the justice and the case was removed to the Circuit Coint Uy certiorari where the judgment was affirmed and error is brought The first alleged error is that all the above facts were shown by oral evidence only while defendant insisted that the draft it self should have been produced ns tbe liest evidence and that no oral evidence of its contents was admissible without first show ing its toss Held That there is no force in this objec tion The action was first brought defendant but for so much money had and re ceived under the transfer made on tho disso lution of the partnership But it is objected by plaintiff that assump sit for money had and receive eould not be maintained because there was no evidence that defendant actually received the money for the draft Held That there arc two sufficient an swers to this objection irst the evidence clearly shows that the draft which belonged to the plaintiff came to the pos session who gavo reoeipt for It in the name of the firm and thus discharged the govern ment fTOin liabilities for the claim and tberc cut off the plaintiff's remedy against tnc government and then instead of hand ing it over to plaintiff' or procuring the money upon it and paying it over he wrong fully deprived the plaintiff of the opportunity of obtaining the money upon it and wrong fully enabled another party to obtain It and it does not naw lie with him to deny that he had himself received the money whether he did in fact receive it or not Second in this proceeding by certiorari whatever the evi dence before the justice tended to show must be taken as proved in support of his judg ment and as the evidence tended to show that the amount of the draft was paid to Hawes at the bank in the presence of defend ant and with his assent and it is a natural and proper Inference that the money was ob
