and tha public ought to remember it if it be a benefit and at any rate remember it as a very great invention We are indebted to Mr Buell for the virtual abolition of grand the enmberaome tedious expensive processof grand juries in this city' Mr Buell did not croihe length of abolishing grand juries entirely Your Honor cin eall a grand1 jury and I believeyou have called one since you have been on the bench and the Circuit Judges can call grand juries when the public welfare seems to require it bu'nevertheless for criminal of fenses and especially petty criminal offenses the grand jury biu been virtually abolished He delivered a lecture of some value upon the subject of grand juries and that lecture is a monument of legal and learning to day wherever it may be He went to the Leg islature and he was the man who got up the system of commencing proceedings by a complaint It has saved thousands snd thoudmds of dollars to the people of this city in the administration of criminal Justice without detriment I think so far to the ends of public justice 'Well our friend Buel is rone 1 said 1 arose with emotion' and I do 1 feel as though I had lost an ok! friend 1 'can hardly realize sir that that Ifamillar face 'and' that fam 11 jpr form that I have seen pass my door a thous and times up and down Jefferson avenue is silent cold and lifeless That voice is hushed But I will try to suppress raymotion and Say no more He has gone Wo shall soon follow his remains with a sense of the loss we have sustained and with dear recollections 'shall cherish hla memory soon to follow him to his silent resting place man wlreh la hla grave can never quit thia gloom Until tne eternal morn shall raise tbs slumberere of the il a 1 At the clash of Mr remarks DB Duffield Reql spoke as follows 1 Maylt please jour I am as moat of the members of this bar are aware surprised and pained at tho announcement of my broth death I did not hear Of his death nor of his illness until my steps were directed toward the court room this morning It seems to me but a few days since he was in our cir cuit When Ideath comes to ns so" suddenly announced it seems to bring with it a painful shock and especially my brother says when it takes away from us one who had been for many years moving in our midst whose face Vm as familiar to us as that of a brother or a father I have known Mr Buel for many years I tur my thoughts back as far as 1844 when he was Prosecuting 1 Attorney of this county and I was just venturing into the pro fession He generally committed to my hands the trust of that high office during his summer absence to the upper lakes and in that sta tion may it please your honor1tTs known to us Uli that bis sphere of practice was wide and the number of his clients very large and the confidence (hat was reposed in him was al most universally expressed and' he had a lar ger business then than any one who belonged to the bar He was in the habit of annually going thither partially for the purpose of ren ovating himself and in later years after his health became better In looking after the large luivicBis iuii were lucre commuted IO mm He has filled perhaps his measure of honor He hah risen from one stage to another Until bo represented us in tne tugnest body In Uie land i Mr Buell 1 think left Congress 10 1850 and returned again to the bar and continued faith fully in the discharge of his duties here He was all that nas been said of him solar as my knowledge of the man gocu an honest faith ful lolling pains taking lawyer and I think there is no member of this bar who can in bls own thoughts recall a single instance in which the propriety of his professional conduct was ever questioned in court or out of court He was a scholar as has been said and an evidence of his culture have by us in the accomplishments of the family which he has reared ill otir midst There is associated with that family a member of this bar who left this city to tender services ia the field and who has been professionally associated since elsewhere than here I therefore out of memory to him as Well as to the virtues of the deceased and his long association with us unite in the motion made by my brother Romeyn in requesting that this court do now adjourn' At the close of Mr remarks Judge Walker said 1 entirely sympathize with the brethren of the bar in their respect for the memory of Mr Buel and their admiration for his charac ter and in their request that a proper respect be shown to his memory 1 have not known him as long as some other members of this bar I came here in 1857 and from that ime I have known him and known him well and I entirely agree with the encomiums that have been passed upon him that he was a pure high minded learned and able lawyer or the last few years his practice has been much more extended in Lake Superior than it has tn the Lower Peninsular Tie has spent Lis summers there nod become very largely In terested in the litigations of that section It will be a fortnight to morrow since I last saw him It was then in the Supreme Court where we arranged for a very Impor tant hearing before the court for next week a matter coming from Lake Superior I had so dream that before that hearing sbofaid come off he would be no more in our midst 1 was shocked this morning coming: out of my house to attend court to learn of his death I had not even heard of any intimation of his ill jiess i JI think it is well when a man of Mr high and qualifications his culture his his purity passes from amongst us that we should pay all proper respect to his memory and that we may all thus feel Impressed with what reverence a true lawyer and a man is looked upon in the community the court will now stand adjourned until to morrow argued and motion granted 1 Watnr Circuit Patrick Sbugrue vs John Sheehy et al Iu chancery Petition to open decree denied The petition in this ease was denied on the ground that the defendants had slept too long on their rights and not used proper diligence in bringing their petition tOjthe notice of the court i Catharine Meuren of al vs1 EdwiffdV Ciebtt On the 22dday of NovemberA 1867 the defendant a sheriff had an execution in his hands against John Becker and John Meu rer and'on that day he levied by virtue of said execution upon the interest of the execu tion debtors and to the leasehold interest of a lot of iland situated on the southwest corner oi Crqghan and Hastings street and the new unfinished store building and advertised the same for sale but he took no possession of the property The plaintiffs were then building thereon the reierred to They continued the building and were in no way Interrupted in' the possession there of ifir They subsequently brought replevin against the sheriff lor tbe building On the trial they proved a lease hold interest in said lot under a lease from Charles Moran for ten years which contained a provision that the buildings which may be erected thereon shall remain as collateral for tbe payment of rents etc and shall not be re moved unless the rents etc for the whole ten years be first paid Two questions arise': irst are the build ings erected by the tenants under such 3 lease personal property so that they are subject to replevin And second If personal property ia the defendant guilty of detaining them from the plaintiffs 7 Tho general rule is" of course that build ings become a part of the reality but where one having no estate in the land erects build ings with the consent of the owner they often become personal property (1 Washburn Real Pr 2) 80 sometimes as between land lord and tenant erections by the latter are per sonal property and may be removed during the term But iu this case the buildings were being erected by the tenants for a term of years1 under an agreement that pre vented the removal thereof during the term As against third persons it is very clear that these buildings were not personal proper ty Nor were they levied upon as personal property but as a part of the lease bold inter est Replevin therefore cannot be maintain ed before an actual removal 6f tho property Nor if the buildings had been personal prop erty could replevin be maintained under the case of Hinsdale vs Hickey 12tb Michigan 99 The defendant made no seizure of the proper ty took no possession thereof nor was tbe possession of the plaintiffs in any way disturb ed The mere assertion of a right by icvy without secure and advertisement is not suf ficient to authorize replevin whatever effect ft might have
