for his supposed connection with Durant robberies nearly two years ago yesterday lodged in jail here having been caught at Gibraltar by Detective Grogan night He has been but the river being between him and our Authorities it was inconvenient to ferry him across ancying no doubt that he was for gotten he returned over and was nabbed Monday January 28 1867 Thermometer vv ma io 19 note the war relators they have not seen each other holds the note heard that Capt town and got upon his track several successive efforts to find him but finally and most happily traced him to the house of Mrs Hunter where he found him in bed with his beloved Leach confessed to the debt and proposed to give good security next day but at the time nominated failed to on ac count of the unwillingness of the person named to endorse While apparently on the best of terms the warrant for arrest was taken out by ellows ami held by a United States Marshal who attended upon them with a faith fulness not often observable in officials Through certain manipulations a most valuable set of fnrs the property of Eliza Cook 'was mentioned as a good security for the amount named and Leach then being in a tight it was proposed that she should place them up the spout for the purpose of relieving him The parties went to Mrs and here an arrangement was effected to relieve her ot the furs in consideration of her acquaintance ship with Leach She gave them up because he said he would redeem them in thirty days and partly perhaps because she loved him so The officer gave her a receipt for them as follows and received a corresponding paper of the contents of which she denies any knowledge: from Miss Eliza Cook one set of mink furs consisting of one cape and one muff in security ot dho note held by Mr Geo ellows amounting to $33654 and ono debt of Tnituao Phelps of $12 and the obligation is this that if Westly II Leach shall pay to George ellows and Truman Phelps their ivtspeeuvc ciaims wunm thirty days Irom the date of this writing the said Miss Eliza Cook Is to receive her furs and this writing tuid agreement shall be null and void If not paid in thirty days then I Eliza Cook agree that the said furs shaM be sold to pay the respective claims of Geo ellows and Truman These furs are described as being very valua ble much more so than the worthless note which caused their extortion even if that were valid The Phelps claim appears to be an in terpolation to cover a real or assumed amount of which little is known In this casejthe circumstances can be regard ed in different lights os judgment on the facts may be taken It is certainly singular that a business man should accept a note with an incomaetent stamp If he did so then the tip per Is worthless and not negotiable The maker might plead ignorance of what was fe quired to make it legal at the time it was af fixed and it would be dangerous for a United States officer to arrest him for a criminal of fense against the national law If the paper is worth nothing then he could not be held on it It was not a forgery Quits face it was given and accepted in good faith a nd the honor of the indebtedness could not perhaps alone but portly justify its redemp tion Its antiquity was not shown neither was any attempt to prove that means had been taken to collect it brought forward But the maker a few days ago comes from Washing ton with a female having valuables in her pos session irst a 8200 gold chain goes by the board then a $400 or $450 set of furs falls be neath a suppliant hammer and these being her all she is abandoned as a bauble from which the sweets have been extracted and left naked so to speak to her fate Whether there was any collusion between the parties named toperform these offices for her tho relation of the circum stances must determine The officer performed his duty possibly according to the dic tates of his judgment but whether he had any right to accept civil damages or collaterals for a prison offense is not on record The respond ents during the examination were on familiar terms and assisted their counsel by mutually considered advice Evidence bickerings of counsel etc occupied the attention of tho court until a late hour The arguments commence this morning and will probably continue during the forenoon Skating Miss Nellie Dean champion skater of Chicago made her first ap pearance last evening at this place and met with a most cordial reception from the large number of visitors present or one of her age she being but twelve years old she certainly has no equal in the graceful evolutions Miss Tillie Leonard champion skater from Chicago who was doing all the intricate and most difficult feats and steps known to skaters with the ut most case and elegance Miss Tillie (who is but fourteen years of age) is superior to and for grace surpasses any one we ever saw Mana ger Welch has engaged Miss Leonard at a great expense and as he never leaves anything un done for the comfort and welfare of his patrons has had erected spacious and comfortable waiting rooms for ladies from which through a long window extending the length of the room can be seen the whole park We pre dict for him with the accession of Mis 4 Leonard great success in his new undertaking has been Mr Summer stated that although I been the yet it port of this proposition but he recommended everyone to Daniel Campau in chancery Motion to confirm the report of the Circuit Court Commissioner on the allowance of the fees of the commissioners iu partition fortheir services Report confirmed This is the Campau partition case in which the bill for partition' was filed by Theodore against the other Campau heirs during the pen dency of the famous case of Campau ra Lewis leaving out of consideration the claim and in terest' ot said Lewis and not making him a party at all to the proceeding but claiming that the whole estate belonged to the other heirs and asking' that it be divided and parti tioned among said other heirs After the de cision of the said Campau vs Lewis case and after the commencement of the Lewis unit fnr partition and on the 21st of May last an order was granted staying Ml further proceedings in this case until the decision of the Lewis parti tionsuit At th time the report of the com missioners in partition iu this case was made and filed and awaited confirmation 'On the 17th day of November following an order was granted in this cause that it be referred to Cir cuit Court Commissioner Gillet to take testi mony and report as to the compensation of vomuiissujuers iu partition lor tneir ser vices in this cause On the 24th of November following said Circuit Court Commissioner made this report ou said reference and now this motion is made to confirm said report Thereupon Mr' Ro meyn solicitor for complainant comes into court and suggests that this suit has been discontinued by consent of all the parties thereto aud claims that such discontinuance puts an end to the suit and that the court has no juris diction to make the order of confirmation asked for He also claims that the parties de sired and intended to make aud file exceptions to the report of said commissioners in parti uvn uui mat me oraer pi may El staving pro ceedings as above set forth prevented them from doing so that such report was imperfect and incomplete and that it was entirely compe tent for all the parties to the suit to discontinue the same by consent without paying these com fees and that the said commission ers must rely upon their action at law against the complainant to collect the value of their services in the cause The solicitors for the conunissioners Riopelle and Holbrook contend that the parties to the suit cannot by consent discon tinue tlie case without the consent of the court until these costs are paid and that it is the duty of the court to retain the cause in court? until these commissioners who are officers of the court have received their compensation for services rendered by the order of the court They also contend that the order of reference of November 17 was an opening and setting aside to that extent of the order theretofore Billiard play ing publie in general are invited to call Jan29 lw WRIGHT opposite the Tenth Ward School was dedleated The exercises were witnessed by a large number of people who not only showed their interest in the success of the school by their presence at its opening but contributed generously towards its support A' number of addresses were made in which the speakers referred to the great good that has been accomplished by these mission schools that gather children from all classes of society many of them entering the Sunday school for the first time in their lives The building which has been fitted up is a commodious wooden structure which was formerly one of tnc barrack buildings near Elmwood avenue It was purchased at the Government sale last summer and moved to its present site nearly opposite the Tenth Ward Union School where it has been fitted up in a very convenient and comfortable manner at an expense of nearly 81200 It is about 80 feet in length by 20 iii width nnd is divided by a partition in two apartments one for the infant department and the other for the infant school The latter is 53 feet long by 20 wide and is capable of ac commodating between 200 and 300 children There were 74 children enrolled in the classes formed on Sunday and ot this number only a few had ever attended any Sunday school A statement of the history of ihe school from its organization to the 'present time was read by Mr Summer The school was organized eb ruary 1 1858 with 34 scholars aud four teachers in the German Reformed Church on Riopelle street in which location it remained for a little over four years The necessity to repair that church required new quarters to be provided for the school and accordingly it was removed to a hall on Clinton avenue between Russel1 and Riopelle streets on the 20th of July 1862 and on October 19th of the same year they went to the Tenth 5 ard School on Lamed street where they did not prosper and it was discontinued for two years when it was again held in the Primary school building on Clinton avenue near St Aubin street In July 1866 the school was again discontinued on account of the want of a building the Board of Edu cation having established a rule not to allow the use of the school house for Sabbath school purposes The friends of Jefferson Avcpue Presbyterian Church having been applied to for aid they purchased the present building and moved it to the lot where it now stands which years the chapel had been the work the Presbyterians yet it was to a union school in the strictest sense and free from sectarianism He invited all Christians of whatever denomination to come in and work in the common cause of Christianity Preaching and weekly prayer meetings are to be regularly conducted as soon as arrangements can be perfected Rev Griffith Mr Bennett of Brooklyn McCarty Rev Mr Ballard Dr Lodge and Rev Dr Hogarth also made some very interesting re marks The latter made an appeal for aid in paying off an indebtedness of 8200 The col lection realized the sum desired aud a balance' of 830 towards purchasing a library and in struction books for the school Goon Detroit No 237 1 of Regular Government officer in a civil capacity are concerned was brought up for preliminary examination yesterday at the Police Qourt As at least one of the parties laid a title to consid erable respectability and honorable business relations the Court room was crowded The complainant Eliza story is in sub stance that she came to Detroit with Capt Wes ley Leach from Washington as has already been stated and while here he was arrested through the instrumentality of Capt ellows for money borrowed from him as alleged and goods furnished The arrest was made by a Deputy United States Marshal
