Argns The Daily ar or $5 in cash for Libel Suit Albany Circuit Court Justus Wright vs Sylvauus Penniman This was an action for a libel alledgcd to have been published by ihe de fendant in the Albany Evening Journal of the 11th of September 1831 The publication stated in sub stance that a sample of oil purchased of the plaintiff for fall strained sperm oil had been tested by South Oleometer and was found to contain 78 parts whale oil and 22 parts sperm oil that whale oil was worth 39 cents per gallon and sperm oil 95 cents and that such mi ture was worth 43j cents That the plaintiffsold it for 87 and gained per gallon 44 cents and thuthoncst oil was selling atone dol lar per gallon a profit of but five cents The defendant did not deny the publication of the libel but insisted as a defence that the matters there in were true The cause came on to be tried on tho 14th instant and the jury after hearing the evi dence submitted to them returned a verdict for the defendant Albany Eve
