The suits ask the court to permanently enjoin the defendants from making such allegedly false statements about their products. Neither firm has filed an answer and one defendant candidly said that a settle-nient is in the works.

Despite the filing of the suits, sentatives of both firms continued to make claims last week about the ability of their products to save energy. Mel Satz, manager of Unity Power Systems of 3001 W. Indian School, said his firm' can install a voltage suppressor at a cost ranging from $149 to $589. The average installation cost for a medium-sized home is around $300, he said. Satz said lie has results of tests which back up his claim that his product will save 7Vi to 10 per cent in power.

But he refused to supply the information to The Arizona Republic or allow a photographer to take a picture of his device without approval of the firm's lawyer. The lawyer, Ted Thayer, refused to give his permission on grounds the suit is before the court and he has not yet filed an answer. Thayer said he has until Aug. 19 to file that answer. "Our experience has been that it does what we say it does," Thayer said.

Unity sells a suppressor manufactured by Goldenberg Enterprises of Minneajv oils. Goldenberg and a California firm, Power Unity Electronics, also are defendants in the suit. At least one of Unity's customers is happy with his suppressor. So happy, in fact, he had one installed on his home after seeing what it does at his business. Cam-elback, said he purchased a voltage suppressor about six months ago. Evans really had strong reasons to want to save energy. His large showroom has 100 flourescent light fixtures and seven five-ton air conditioners. His power bill often runs more than $1,000 per month. Evans admits he is still on the fence about the device but he feels more positive than negative about it "I told a friend who is an electrical engineer that I didn't see how it could work," he said.

"It seemed too good to be true." One of the benefit claims which appealed most to Evans was the possibility the suppressor might make his flour- age "within 30 seconds" and found it engulfed in flames. He said he saw Thomas Downs "out of the plane, running around, shouting, 'Save them, save them, get them out of He was in deep, total shock." Another witness said he was working on his plane near the runway when he saw a woman, later identified to him as Mrs. Downs, run past shouting, "That plane just crashed. They just crashed." The witness said he drove to the crash site and saw Thomas Downs outside the plane, in an obvious state of shock. "The back of his hair was all singed," the witness said.

"I guess he might have gotten out just as the thing burst into flames." The fire was put out by units from the Rural Metro Fire Department. An SRP spokesman said Downs had worked for the utility since November 1973. Eric was a second grader and Todd a fifth grader at Squaw Peak Elementary School.

FAA investigators said they had not determined why the plane was unable to gain sufficient altitude to clear the powerlines. They said Downs had not radioed of any problems. in Tucson said he sat down with power company officials as soon as his firm went into business last January. He said he also met with members of the press but that neither meeting brought much support." Lien claimed his product is superior to Unity's and was developed with more research. Lien said his firm's attorneys are discussing a setlement with the' attorney general and believes the company will modify its advertising to please the office. Anthony Ching, chief consul for the, Attorney General's economic protection division, wouldn't comment about the' specific cases. He did say that the division is concerned about exaggerated claims for any such devices. "We're not saying such devices are.

worthless but that they're being repre-' sented as saving power," Ching said. According to a publication put out by the Better Business Bureau tests have failed to confirm significant power savings from TVS's. Some studies, however, have shown some benefit to trical equipment, the report said.
