WPW.W:JWWf -V)T-flinmrTir I III III im mpilini Phoenix, Sunday, June 4, 1961 The Arizona Republic E-29 New Law Affects Tract Land Sales Truck Line Terminal Job Started The provisions of Senate Bill S3, relating to subdivision land sales, go into effect June 23. It will have a far-reaching effect on such par-1 1 1 a 1 on desert land sales, according to J. Fred Talley, state real estate commissioner. Because of it, a new sub EAST CULVER The plant shown above is being erected at Culver and 50th streets for Air Reduction Co. primarily to supply the adjacent transistor plant of Motorola with oxygen, hydrogen and nitrogen, which are used in large quantities by that firm.

Building and equipment will cost $1 million, Varney and Associates is architect; TGK Construction contractor. Motorola will get its supplies by direct pipeline. Talley Work was started last week on construction of a terminal facility at 2400 Black Canyon for Navajo Freight Lines. Plans for the structure, which will cost approximately $250,000, including the five-acre site, were drawn by Ralph Haver and Associates, architects. The construction contract is held by Gilbert and Dolan.

The trucking terminal will have 17,500 square feet of space and will front on Black Canyon Highway. There will be 19 doors to the loading and unloading dock. Black top will be placed on four acres to provide ample truck and other vehicle storage. The building is to be ready for use by Sept. 1.

At that time Navajo will move from its present location at 2100 S. 15th where it has been located for the last 3'j years. Laurence Cohen, president of the trucking company, was here from Denver for the ground breaking. The Phoenix terminal is one of 53 Navajo operates in major cities of the nation. LOCATIONS Air Reduction Plant To Supply Motorola division questionnaire has been compiled clarifying the subdivision statutes.

He is urging everyone dealing in real estate to obtain this and familiarize himself with the provisions. SB 93 defines a subdivision as: "Subdivision or subdivided lands means improved or unim er immediate or future, into five or more lots or parcels." IT BECOMES mandatory for the owner, agent or subdivider to notify the commissioner of his intentions before offering subdivided lands for sale or lease Talley pointed out. "The commissioner is -quired to investigate any subdivision offered for sale or lease and shall make public his findings," Talley said. "In thiS connection, the attorney general's office has ruled that whether described as lots on a plat or staked out by metes and bounds, the enterprise constitutes subdividing if such subdivision results in five or more parcels or lots proposed to be divided for purpose of sale or lease. "The attorney general also has ruled that provisions of amended act pertaining to subdivided lands apply to all sales or leases, regardless of whether they have been previously platted or recorded; or whether they are being offered for sale for the first, second or third, time." TALLEY SAID failure on the part of the agent, owner or sub-divider to comply with the provision of the act in relation to offering subdivided lands for sale or lease will constitute grounds for criminal action.

The law is plenty stiff in this respect. It provides for a fine of not more than 10,000 and imprisonment not to exceed two years, or both, upon conviction. In addition, conviction would constitute grounds for revocation of the real estaU broker or salesman license. It's imperative that all sub-dividers become familar with the provision of this act as relating to subdivided land, Talley said. proved land or lands divided or proposed to be divided for the purpose of sale or lease, wheth- Appraiser kWins Honor Richard M.

Dyer said the gases will be manufactured from city water and air. Oxygen and hydrogen are obtained from the water by an electrolytic process.

THE NITROGEN will be obtained from the atmosphere, of which it composes approximately 70 per cent. It was pointed out by Motorola officials that the new supply source will eliminate use of several hundred trucks per month making deliveries of the gases from other sources. The new installation is completely automatic. To operate it only two persons per shift on a 24-hour basis will be required, Dyer said. Work is being pushed by TKG Construction Co.
