Mrs. Stevens said she was therefore upset when she learned of the high percentage of names that were disqualified. On June 22, she said, 9.913 signatures were submitted. The remainder were submitted on July 8, one day before the filing deadline.

Because of the volume of signatures, County Recorder Tom Freestone said earlier that the task of checking the signatures wasn't completed by the 5 p.m. deadline last Friday. Mrs. Stevens said that of 15.431 signatures sub-' mitted by the party in Maricopa County, only 8,023 were verified. Signatures of 78 others were rejected because the signers lived in another county; 66 signers were determined to be too young; 5,542 were claimed to be had a "reasonable" chance of "making it (the ballot)." Nicol testified that it required a lot of time and effort to check the signatures and that it would be a waste of tax money if the parties didn't have a chance to get on the ballot. In arguments before McCarthy, Esser said the Libertarians need only 500 more signatures to get on the ballot.

The number of valid signatures to qualify for the ballot is 11,045. er so that they could have been verified by the deadline. But in her testimony, Mrs. Stevens said Nicol told her and representatives of other parties that he didn't want the petitions to dribble in in small amounts. Nicol testified1 that he urged Mrs.

The special action was Filed by Libertarian Party member Helen J. Stevens of 6 33 1 N. 83rd Scottsdale.

She testified Wednesday that in two hours, she validated 34 petition signatures which the Maricopa County recorder's office said were invalid because the signer's weren't registered voters. Mrs. Stevens said the percentage of signatures claimed to be invalid was much higher than she expected. She said that David J. Nicol, county elections director, had told her that normally 60 to 70 per cent of signatures on petitions are valid.
