'A If i Samaritan Hospital, costing more THE Arizona Supreme Court Saturday issued a writ of habeas corpus freeing E. B. Chitwood from the Pima County Jail under $1,000 bond, where he had been held since Sept. 6.

Chitwood, alleged former owner of a gambling casino near Tucson, had refused to answer questions whether he had business dealings with Fred O. Wilson, state attorney general, and was jailed for contempt by Superior Court Judge Lee Garrett in Tucson. His attorney, Edward W. Scruggs, filed petition for a writ of habeas corpus in the supreme court last week, but the writ was denied. The court at that time held the petition was not legally sufficient.

The writ was denied without prejudice to the petitioner, which meant it could be refiled. The writ, issued Saturday by Justice Arthur La Prade, is returnable at 10 a.m., Sept. 24 in the supreme court chambers at Phoenix. At that time Frank Eyman, Pima County sheriff, must justify holding Chitwood in jail. The legal steps are part of the bitter fight staged between Robert Morrison, Pima County attorney, and Wilson, both of whom sought the Democratic nomination for state attorney general.

Wilson won the primary last Tuesday. Morrison filed charges of bribery and conspiracy against Wilson in Pima County relating to alleged activities there several years ago. Chitwood was one of the witnesses called to substantiate these charges. He refused to answer on grounds he might incriminate himself. Wilson has filed libel charges against Morrison.
