1 sought Embezzlement reversal is upheld The Arizona Supreme Court Thursday refused to overturn a March 1974 ruling by the State Court of Appeals that reviewed the conviction, of an Iowa man accused of embezzling $22,000 from a Phoenix construction firm. The high court ordered a new trial in Maricopa County Superior Court for Darwin Loy Vanderlinden, 33, Murray, Iowa. The state had appealed the ruling by the appeals court. That ruling held that Superior Court Judge Harold D. Martin erred in refusing to instruct the jury on a lesser charge at Vanderlinden's trial.

According to trial testimony, Vande: linden was employed by an accounting firm in 1972, and was conducting an audit for Stacey Construction 2515 E. Thomas.
