2B MID - HUDSON WEDNESDAY, DECEMBER 24. 2003 PDUGHKEEPSIE JOURNAL Court reinstates SUNY harassment suit POLICE BRIEFS TtM Associated Press KINGSTON A federal appeals court has reinstated a sexual harassment lawsuit filed by a former student against her professor at the State University of New York at New Paltz. The court, in its ruling released Monday, also found the college, the SUNY system and individual college officials acted properly in addressing the allegations, and could not be held liable. The suit by Inbal Hayut claims political science professor Alex Young repeatedly compared her to former White House intern Monica Lewinsky during 1998's presidential sex scandal. A lower court dismissed the case last year before it went to trial, determining the professor's comments were offensive but did not rise to the level of legally actionable sexual harassment. But Monday, a two - judge panel of the U.S. Court of Appeals, Second Circuit, found aspects of Hayut's case against Young could be construed by a reasonable juror as constituting sexual harassment as defined by state and fed eral law, the Daily Freeman of Kingston reported. Hayut took Young's class in the fall of 1998 as revelations of an affair between then - President Bill Clinton and Lewinsky made headlines daily. Young, according to the lawsuit, repeatedly compared Hayut's appearance to Lewinsky's, called her "Monica" in class and once told her. "Be quiet, Monica, I'll give you a cigar later," an apparent reference to allegations that Lewinsky and Clinton had used a cigar as a sex toy. Comments not denied Young did not deny making the comments, which Hayut said made her reluctant to go to class and caused her grades to decline, the newspaper reported.
