F. Urorer, Gov-ernor of do hereby tuspehd the execution of the same, and of said warrant, from the 15th day bf A.

I). 1375. named theroin to the 3i)th day of January, A. D. 1875, on which last named day, between the hours of one and three o'clock in the afternapn thereof, said warrant shall take effect, and be executed in the samo manner as if this reprieve and suspension ef sentence bad not been granted And I rail upon the said Sheriff of said county of Marion, and his Deputies and all officers whose duties are afioctcd hereby, to see that this, my ord jr, in the premises ba carried into effect.

To the Sheriff of Marion county. State of pre- giui, and to his deputies, greeting: hereas, at a regular term of tha Circuit Court of the State of Oregon; for the countv ot Mai began and held at the court house in Saluin, Oregon, on the Hth day of June, a. t. 1874, Thomas Gerrand was dulvindicted for the crime of murder in the first degree, in killing on Thomas J. Hubbard, ripen which indictment the said Thomas Gerrand waa duly arraigned, pleaded Xot Guiltv.

and was. at the regular November Term, a. n. 1874, of said Cir cuit Court, duly tried and found guilty as charged in the said indictment. Pursaant to which it was on the 10th judicial dsy of said term, the same being the lttth dav of November, a.

D. 1874. dulv ordered and adjudged that the said Thomas Gerrand be. on the day of January, a. i.

1875, and between the hours of one and three o'slock in the afternoon of said day, hanged by the neck until he be dead. And wheresa, the said cause was duly appealed to the 8uprema Court of the State of Oregon at the December Term thereof for the year 1374, ia which court, alter argument of counsel and due consideration by the said court, it was, on the 13th judicial day of said Wm, tba same being the Sth day of January, A. r. 1875, ordered and adjudged that the judgment of the Circuit Court aforesaid, be in all things athrmed. and therefore it was ordered that said Circnt Court aforesaid proceed to carry its ssid order and judgment into execution.

Now, therefore, in the name of the State of Oregon, yuu and each of you are hereby commanded that on the 15th day of January, A. n. 1375, you take the said Thomas Gerrand from the place of hia contineasent ia tlie common jail of said county, to the place of execution in said countv, and that yon then and there, between the hours of one and three o'clock in the afternoon of said day, csnae tha said Thomas Gerrand to be hanged by the neck until ba be dead. Hereof fail not at your peril, aad make due exeontion and proper return of this writ. Witness, Hon.
