THE TENNESSEAN Thwdaiy, Nownbf 7 199 SB LOCAL NEWS Clean record wins early release in drug case TVA property a sticking point in expansion of trade center and Rosemarie Bryan asked for a reduced sentence and probation for Schiappa. The two were arrested in December at a local motel after law authorities videotaped a discussion over a huge cocaine deal. No money or drugs were exchanged, though Stamegna gave a bogus $670,000 note for property over which he no longer had control. CHATTANOOGA (AP) A Hamilton County judge has set free a one-time affluent California contractor charged in a plot to sell 40 kilograms of cocaine. Criminal Court Judge Gary Gerbitz said Eugene Schiappa, 55, had an otherwise clean background and should be released after one year in jail.

"I have never come across many cases where the support factor is so he said after making his decision Monday. The state had problems with the paid informant who carried out the reverse sting on Schiappa and his brother-in-law, Ivano Sta-megna, 40. Schiappa and Stameg-na received nine-year sentences on pleas of attempting to purchase more than 300 grams of cocaine. Defense attorneys Hugh Moore CHATTANOOGA (AP) A block of old buildings has been toppled to make way for the city's $40 million trade center expansion, but one has yet to fall and it involves property owned by TVA. The Tennessee Valley Public Power Association building, used by the cooperatives and utilities that buy power from TVA, must be demolished and cleared by next July for the expansioa TVA owns the property, but not the bui'ding, spokeswoman Barbara Martocci said yesterday.

TVPPA got a $1 permanent easement from TVA on the building when it was constructed more than a decade ago along with the TVA business complex downtown. Martocci said TVA told trade cen 13,000 square feet of the TVPPA site. But Schaerer said the board also needs some 27,000 square feet of space for the expansion where TVA now has a parking lot An exchange of the surplus land for the parking site may be possible, Schaerer said. Architect Alan Derthick said redrawing expansion plans for the trade center that do not include the TVA property wasn't possible given the other development in the area He said the TVA property was needed to provide a loading area for tractor-trailer trucks at the rear of the trade center. Trade Center executive director Tim Riddle said a resolution on payment for the building and property easement may not come until early next year.

ter officials that once they and TVPPA agreed on a purchase price for the building, TVA would give them an easement for free. But E.T. (Bud) Schaerer, a member of the Carter Street Corp. board, which oversees the trade center for the city and county, said TVA told CSC that pending d'eregu-lation means the agency "must operate as a business in all its dealings." Schaerer said TVA officials added that the agency is under severe budget constraints and must maximize its dollars. Therefore, CSC may now have to pay full-dollar value for the TVPPA site as well as paying for a replacement building and moving costs.
