a THE COURIER JOURNAL, FRIDAY, SEPTEMBER 20, 1991 5 Zoning recommendation delayed on Middletown site sought for gas station SHELDON SHAFER Staff Writer Middletown residents' protests escalated to a brief walkout as they tried to fend off rezoning for a proposed Thornton Oil gasoline station and food mart at a hearing yesterday. The opponents walked out when the city-county Planning Commission decided to proceed with the hearing after a co-developer withdrew his half of the project. But after hearing nearly two hours of debate, the commission voted to defer a recommendation on new zoning for the Thornton project. for at least a month. The oil company has requested a change from single-family to commercial zoning on the southeast corner of Shelbyville Road and Urton Lane.

The one-acre tract is just inside the Gene Snyder Freeway. The Middletown City Commission will ultimately decide the matter. Leslie Aberson, a co-applicant with Thornton, filed for new commercial zoning to develop up to 15,500 square feet for retail and restaurant use on a 2.7-acre parcel adjoining the Urton Lane tract, which Thornton found recently. George and Laura Leong own the land needed for both parts of the project. But: at the start of yesterday's hearing, Aberson withdrew his portion of the application, and his attorney, Glenn Price said the opposition was a factor.

He pledged that Aberson will eventually refile the application. Lawyer Terry Wetherby, a former Middletown commissioner who represented the Middletown Alliance, which is opposing the rezoning, pleaded for another hearing to be scheduled on the scaled-down proposal, or at least for more time. She said the opponents had prepared testimony based on the larger project. Thornton representatives said they want to build as soon as possible and wouldn't mind if the opposition also considered the impact of the Aberson project in arguing the case. At that point Wetherby and about 15 other opponents walked out. After about five minutes, they returned and threatened to sue the planning commission. The opponents cited traffic, drainage and air pollution concerns. They also argued that the service station could go on nearby vacant land already commercially zoned. Also yesterday, the commission: Gave final approval to revised plans for the Springview subdivision, planned on 68 acres near Willowview Boulevard and Taylorsville Road near Jeffersontown.

A development group headed by Hunt Garner plans 499 single-family homes selling from around $75,000 to the low He revised the plan to build more single-family units after dropping plans for about 240 apartments. Recommended that the Louisville Board of Aldermen rezone 1.8 acres in the Shoppes of Audubon Park development on Preston Highway opposite Audubon Park for a proposed office, storage area and drop-off center for an air-express company. The developers declined to name the tenant. Recommended that the aldermen deny new office zoning at 204 Meridian Ave. requested by Gilda S.

CRIME REPORTS SEXUAL ASSAULTS A 13-year-old girl said a man with a knife grabbed her in the 3500 block of Del Park Terrace and threatened to cut her before she was blindfolded and raped at 7 a.m. Monday. A 15-year-old girl said three men pushed her into an entryway at a Phoenix Hill apartment building, where two of them raped her at 5:30 p.m. Tuesday.

A 47-year-old woman said two men who were supposed to give her a ride home took her to the 2400 block of Echo Trail where they raped her at 2 a.m. Tuesday. ROBBERIES J. C. Penney Co.

Brown 37, of 405 W. Hill was pronounced dead at Humana Hospital-University about 6:35 p.m., Deputy Jefferson County Coroner Jorge Quiroa said. Brown died of multiple injuries, Quiroa said. According to police reports, Brown was driving south on the Gene Snyder between Interstate 71 and Westport Road when the accident occurred around 5:45 p.m. Brown was taken by helicopter to University Hospital moments later.
