V' H--J lh PAGE TWENTY-TWO THE HOLLAND, MICHIGAN, EVENING SENTINEL WEDNESDAY, AUGUST 12, 1970 Defense Rests In Collins' Case ANN ARBOR (UPD--The defense today unexpectedly rested its case i the John Norman Collins coed murder trial without calling the handsome, former student to testify in his own behalf. After conferring for one hour and 15 minutes with prosecution attorneys and Washtenaw County Circuit Judge John Conlin in the judge's chambers, defense attorney Neil Fink said in court, i "Your honor, it is our considered and professional judgment that the prosecution has failed to Conlin interrupted him, saying "Avoid the speeches Mr. Fink." "The defense rests," Fink answered in the hushed courtroom. I Throughout the conference, speculation had mounted whether Collins would testify in his own behalf in the first-degree murder trial. In the chamba-s, Fink and chief defense attorney Joseph Louisell had apparently sought to persuade Conlin to restrict the prosecution's cross-examination of Collins if he took the stand.

The defense brought only 11 witnesses to the stand during its four days of testimony. Three of those witnesses were scientists who rebutted a key piece of prosecution testimony-that hair found on Karen Sue Beineman's panties came from the Ypsilanti basement where the prosecution said she was tortured, sexually abused and slain. Collins. 23, a former Eastern Michigan University senior in neighboring Ypsilanti is charged in Miss Beneman's death. She was the seventh and last young woman slain under similar circumstances within two years around Ann Arbor and Ypsilanti.

No one has been charged in the other deaths, but Collins faces a murder charge in Monterey County, in the similar sex slaying of a 17-year-old girl near Salinas in June, 1969, while he was visiting the area. Miss Beineman disappeared July 23, 1969, and two prosecution witnesses said she rode off from an Ypsilanti wig shop on a shiny motorcycle driven by Collins. That was the last tune she was seen alive. After the announcement that the defense was resting its case without bringing any character witnesses to the stand, Washtenaw County Prosecutor William Delhey said he would present one or two rebuttal witnesses. When they have finished testifying, both sides will make their final arguments; Conlin will instruct the jury in the law: two of the seven men and seven woman on the jury will be eliminated by lot; and the remainder will determine Collins' fate.

The jury is not expected to get the case until Thursday. There have been 16 days of testimony in the trial, and a total of 58 witnesses have appeared, 47 of them for the prosecution. It took five weeks to select a jury, and once the 14 were seated they have been locked up throughout the trial. Mary Olenchuck Police Searching For Missing Girl OGUNQUIT. Statement Planned On Textbooks MARQUETTE (UPI) The, State Board of Education announced today it is drawing up a policy statement for public' school officials detailing district-! by-district costs for implementing a free textbook program. The Michigan Supreme Court ruled last month that all public schools are required by the state Constitution to provide their students with tree textbooks and school supplies. Dr.

John Porter, acting superintendent of public instruction, said staff members in the Department of Education plan to submit requests to the legislature for supplemental appropriations to help bail out schools facing economic pinches as a result of the new ruling. Porter said work will begin on the costs estimates as soon as Attorney General Frank J. Kelley issues a statement detailing the implications of the textbook ruling. The opinion is expected later this week. When the cost estimates are drawn up, they will be sent all public school superintendents to help them plan for the coming school year, Porter said.

In other action at its monthly meeting, the board gave two schools permission to cut class hours next year below the legally-required minimum and postponed action on similar requests by ten other school districts. A new ruling requires schools to offer at least 900 hours of classroom instruction each year unless districts find it impossible because of either classroom shortages or extreme financial difficulties. Permission to cut classroom hours was given to Bedford and Elk Rapids public schools. Officials from those schools said problems of classroom shortages would be solved by the following year. Similar requests by ten other school districts were postponed pending further information.

In Newry. 55 miles southeast of Londonderry, Police Constables Samuel Donaldson, 23, and Robert Miller, died of injuries suffered in the explosion Tuesday night of a booby- trapped car. Police refused to speculate whether the booby-trapping of the car might be connected with the province's secretarian strife. The car had been reported stolen four days earlier and the policemen were examining it when it exploded. A bomb went off outside a hairdressing establishment in Belfast early today, breaking windows in the shop and an apartment above it.
