spend some time before going to their jail in (ietault of 000 bond One of the most interesting cases tried in the court this week wasthat of the government against John Casper of Winston and Smith deal of Advance Davie county Casper who is the in the Casper Company a big liquor concern of and Smithdeal comprised the Bixby Consolidated Company of Bixby Davie county This Bixby Company inserted a large ingeniously worded adver thseinent in the newspapers offering at half full quarts Under this alluring (to the thirsty) heading the Bixby Consolidated Company praised their whiskey and told at length wha fine goods tliey had They closed by proposing to ship full bottles for $550: 20 bottles for $10 40 bot ties for and they proposed to give to the purchaser of $10 worthof whiskey full quart of 10 year old or to the purchaserof $20 worth bottles of 10 year old Thu advertisement was so well worded and the words and socarcfully inserted that the average purchaser thought he would get ten quarts for $5 50 20 quarts for $10 etc 'when in fact for the sums named he re ceived only ten pints and 20 pints respectively If a kick wasmadeat tention was called to the fact that the Bixby Company only offered ten buttles nut quarts for $550 and 20 buttles for $10 and nothing was said about the size of the bottles It was only proposed to give one quart free to the purchaser of $10 worth and three quarts to the purchaser of $20 worth The Bostoffice Department how ever took notice of the advertise ment and Casperand Smithdeal were indicted for using the mails for fraudulent purposes Col JohnWi ley Shook who is special counsel for the Casper Company at Winston se cured the consent of the government officers to compromise the case for $100 but Casper and Smithdeal re fused a compromise They liad em ployed as counsel Judge By num of Greensboro and Mr Swink of Winston and the case went to trial Tuesday Thegovern inent offered its evidence and the de fence offered no testimony Judge Bynuni argued that there was no fraud for the advertisement did not su5' the Bixby Company would give ten quarts of whiskey for $550 r20 quarts for $10 but full and and nothing was said about the size of the bottles of which was true The jury however thought the advertisement was intended to de ceive and they found the defendants guilly in less than fifteen minutfsaf ter they retired Casper the senior member of the firm was lined $250 and Smithdeal was lined $50 There upon Col Shook snickered in his sleeve will take rny advice next he said Wednesday morning about 11 o'clock Mr John Sullivan attempt to secure an increase of pension He was a deserter from the Confederate army and otherwise appearently a most sweet scented geranium and while there was nothing about him to in spire respect one could but pity Ho appeared unmoral rather than immoral his condition both physi cal and mental was pitiable in the One of he best minstrels on the extreme His Case gave the judge ad CKS in i i I
