date line of Sherrill 'White Corny THE WADESBORO LYNCHING The lynching at Wadesboro is to be deplored just as all acts of' law lessness are to be deplored The Wadesboro man was in the bands of the law and while the first trial bad failed there was yet another trial ahead of him and full opportunity should have been given the courts to vindicate the majesty of the law If the mob which lynched Johnson was composed of drunken and irre sponsible men as is represented it is not probable that they were actu ated by the idea that the way to prevent crime is to promptly and effectively punish criminals And yet we cannot but call attention to the disposition of mobs to take hold where the law has failed ormerly the victims of mobs were a class of criminals of whose punish ment there could be no sort of doubt if the law was left to take its course But latterly lynchers are disposed to take up the work where the courts have failed It is just as well to pause here and inquire whether there is not a reason for this In far away Louisiana just two days after the Wadesboro incident a white man was lynched He had been twice tried and failed of conviction and it is said that the lynching was prompted by the fear that he would finallyescape through the technical ities of the law That the law too often fails cannot be denied The criminal especially in a capital case has every advantage in North Caro lina The law is so carefully framed in his favor that it is now almost impossible to convict of murder in the first degree In addition to the difficulty of proving premeditation the law gives the defence all the ad vantage in selecting a jury so that it is comparatively easy to select a jury that will not convict of a capital offence It is said the Wadesboro man could not have been convicted of first de gree murder Probably he should no have been we are not familiar with the facts in the case It is said now that he was insane and that he would have been admitted to the State Hospital at Morganton some time ago if room could have been found for him although it does not appear that insanity was plead in his defence at his trial But if he was insane the crime of those who took his life is so much the greater and the members of the Legislature and through them the people of the State are responsible in that they failed to make provision for such as le Nolaw abidingcitizen who reflects on what it means can defend lynch ing and nobody will contend that a life should be taken because of public clamor He is entitled to atrial in the regular way and should lave the fullest and freest opportu nity to defend himself But Tire Landmark does contend that the re peated failures to enforce the law and the escape of notoriously guilty men through the his name was by the guards when he attempted to escape from a convict camp near High Point a few days ago was a sad affair Tire Landmark has always doubted whether convict guards bad the moral right or should have the le gal right to kill a prisoner who at tempts to escape especially a pris oner who has been guilty of some of the lesser offences But the guard must shoot or let the prisoner go and sometimes the shooting is fatal McMillan appeared at Greensboro last fall a full fledged sport He was apparently well bred and knew all the gaits He at once forged to the front in the smart set of the social circles and cut a wide swath This lasted for a little time and then he was detected in forgery There was every indication that he was a hardened sharper He was tried and sent to the roads He made a plan to escape with some colored convicts He and one of his colored companions were killed and the oth ers escaped Being urged when at the point of death to tell about his people the young man said his name was Amory and that his people lived in Ken tucky Diligent effort has failed to locate his people at or near the place he named and the conclusion is that McMillan lied with his last breath With his last breath he charged cru elty at the convict camp This has attracted attention and a good many editors and other people moved by sentiment are slopping over about it If there is cruelty to prisoners at the convict camps in Guilford or anywhere those guilty of the cruelty should be removed and punished All prisoners should be treated hu manely But because a convict says he is cruelly treated make it so Some of them allege cruelty when they are made to work To a society sport like McMillan work on the roads with a ball and chain on his leg wife cruel but the law recognize distinctions To show the extent of the sentiment in this Mc Millan case it was stated in one newspaper that McMillan had been buried in the field and thereupon the chairman of the Guil ford commissioners a High Point man indignantly denied this inti mating that be considered it a slan der of the High Point people to say they would allow the man to be buried in the field and it was also sent out to the newspapers that flowers "had been placed on Mc grave All this was credit able to the kind hearted people of High Point but as the Greensboro Record has pointed out all this gush case Correspondence of The Landmark Mrs rances Ellen aulkner whose death was briefly' noted in Unis Landmark of yesterday died at her home in east Stony Point Satur lay morning last after years of Affliction in her 84th year She had or years been quite feeble and for three or four years had been confined her bed most of the time being a victim of cancer and almost totally blind Her maiden name was Harris and she was the mother of four chil dren three daughters and one son Mr Jas aulkner of Charlotte The latter and two of the daughters Mrs Harris and Miss Annie aulkner who lived with her mother Mrs husband wap a Confederate soldier and died during the civil war probably in the summer of 1864 under rather pecu liar circumstances He was at home on furlough or possibly sick leave and had a spell of typhoid fever He had so far recovered from the attack that he was able to be up and out o' doors when one day he ate an apple and as a result the next day he died Mrs aulknefhad lived at Stony Point a number of years though her name remained on the Iredell pen sion roll and she has always drawn her pension from that her native county uneral services were con ducted at Stony Point Sunday by Rey Weaver and her remains were there laid to rest A good wo man gone A family of six persons from Wilkes county named Morgan ar rived in thisneighborhood last week in very destitute circumstances and are making their home temporarily in a tenant house on the land of Mr Lowrance near the Cheat ham ford They consistof the grand mother 89 years old the mother and her son and his wife and children The man is comparatively young but is a victim of consumption and hds notbeen able to do any work for a long time He is lying at the poim of death having exhausted his means in searching for relief from the dis ease People in the neighborhood are supplying their present wants but the outlook for the family is very gloomy indeed They lived in this section for a short time of Miss Minnie Umberger a hospital nurse who committed suicide here with gas show that her home is in Mount Ulla that her father is a minister and that her name is Mrs Umberger The cene of the suicide Before she disrobed yes terday she placed one end of a tube over the gas jet attached a tin fun nel to the opposite end and lay down to end her earthly sorrows Her body was found about 6 by Billings an umbrella maker from whom the nurses rent their apartments on the second floor of the above number He said he was first attracted to the room by the smell of gas coming down into his apartment through the pipes of water the heat er He first notified police headquar ters and the ambulance with Dr George Pipkin went to the home Dr Pipkin then notified Deputy Coroner Parker who viewed the body and ordered it sent to New undertaking room The coroner said that an inquest would not be necessary Miss Umberger was about 30 years old and had graduated from the Scarritt Bible and Training School Askew and Harris avenues six years ago Miss Umberger must have gone about her preparations for death in a most deliberate manner On a dresser near the body was found a box of bichloridq of mercury tablets A glass of water in which some of them had been dissolved was also found It is believed that she at first took the poison and finding the pain very great attached a tube to the gas jet placed the on the opposite end and packed absorbent cotton in the places where tube did not fit The position of the body show ed that she lay back on the bed with her feet still touching the floor and inhaled the gas until death came The door to her room was open leading out into the hallway and if she had merely turned onthejetand laid down it would have taken longer to accomplish her purpose Eleven nurses do lighthousekeep ing at this number and most of them iave been there one year and three months Miss Umberger went there 15 months ago It has been the custom of the nurse who remains at icme to attend to the rooms and do the other light house work Miss Umberger had been alone in the apartments Billings said since Sat urday morning It is not known just what time she committed sui cide
