Temporarily The Case of Vonns Durham rom olk Raleigh Times April 25tb rail Durham the young white man from Polk county is still here unable to get in the penitentiary to serve his 14 year sentence for killing Deputy Sheriff Hinton in Polk while the officer was arresting him for carrying concealed weapons He came here lastThursday under bond accompanied "by his mother and brother and is at the Yarboro with his mother the brother has gone back to Polk county to nuke some arrangement for either an offi cer to come from there or to have the sheriff of Wake or other officer here deputized to deliver the prisoner It developed after Durham arriv ed here that the Sheriff of Polk could not come owing to the fact that court is in session this week and the clerk of Polk court offered to send the official commitment here so that Dur brother could deliver him to the penitentiary authorities But Durham declared that he did not wish to be put in the attitude of committing his own brother to the penitentiary so he returned to Polkcounty a few days ago to arrange either for an officer to come here or for the authorization of Sheriff Page of Wake to mike the delivery In the meantime rail Durham spends his time walking about the city sight seeing He has called on a number of the State officers with whom he is acquainted at thecapital including Attorney General Gilmer who as an official duty argued for the State before the Supreme Court in opposition to allowing Durham a new trial Durham could be seen last evening seated on abench in the capitol square wearing a white vest and patent leather shoes quietly smok ing a cigarette Little did passers by suppose that the youth was here trying to become an inmate of the penitentiary and that thus far his efforts hati been In vain This is the most remarkable case on record in this State It is re markable not only for the fact that the prisoner is unable through such peculiar circumstances to get into the penitentiary to begin the service of his sentence but also for the un usual circumstances of the crime Durham was arrested by a depu ty sheriff and while arranging to give bond he ran The deputy ran after him and fired on him and Dur ham shot and killed the officer Of course he claimed self defence but that go with the courts and he is under sentence of 14 years having been convicted of murder in second degree His going to by birth and married Mr Robinson about 28 years ago She was a devout Christian a member of the Presbyterian Church and ap proached death fearlessly There are three children surviving Mrs McDiarmid of ayetteville issEl len and Ed mond Robinson Mr Robinson is pastor of the Pres byterian churches at North Wilke i boro Wilkesboro and Elkin is one of our best citizens and much sym pathy is expressed for him in this sad hour Mrs Vannoy died at her home at North Wilkesboro on the 21st bronchitis being the cause of her death She was about 70 years old was the wife of the late Maj Vannoy who preceded her across the mystic river in January 1905 She was a consistent member of the Methodist Church a devout Chris tian honored and respected by all Rev Ownby conducted the fu neral at the residence after New Berne last week was that in I which the commissioners of Pamlico 1 1 county were convicted of failure to comply with an order of the United 4 States War Department regarding the obstruction of a navigable stream by failure to provide proper draw in the bridge The commissioners set up the plea that an act of the last State Legislature has taken the matter of the care of roads and bridges out of their hands and nut them under the supervision of the board of magistrates so that they were not responsible Judge Purnell held thisact on the part of the Legislature made no dif ference as under the provisions of the twelfth article of the United States constitution the regulations prescribed by the United States government must be the law of the land And the War Department had specified the
