The Incentive package, be said, has helped lure "the largest single Investment of foreign capital in VS. history" to Kentucky. The 1986 General Assembly approved the Toyota Incentives as part of a bill that also created a mechanism to allow the state to Issue revenue bonds to finance the purchase and Improvement of land given to industries.

The legislation allows the state to offer such Incentives if the company's taxes will. In effect, reimburse the state. But Hubbard argued yesterday that Toyota's future taxes cannot be viewed as offsetting the cost of the land, because the company would have had to pay the taxes anyway. Much of yesterday's debate concerned whether the Toyota package is too extravagant and constitutes a legitimate use of public money. Harper said that though a strict reading of one section of the constitution prohibits gifts to private companies, at least one other section recognizes that luring business and jobs to the state Is a legitimate public purpose.

Harper said the package's cost will be more than offset by future tax revenues and the 3,000 jobs that the plant and related industries are expected to provide. But Hubbard said Toyota has given the state no guarantee that it will employ 3,000 people. And he said the total cost of the state's Incentive package probably will be more than the $125 million projected by the administration. "Under the best of circumstances it may be a break-even deal," he said. William Scent the attorney representing Hayes, argued that the "public-purpose" Issue is Irrelevant The real question is the bonding mechanism.

Scent said. That mechanism is unconstitutional because it forces future legislatures to repay the bonds "solely and totally out of future revenues." In the Court of Appeals, Hammond's attorneys continued to argue that Toyota should be prohibited from proceeding with construction while Hammond challenges the air-pollution permit Earlier this month, Scott Circuit Judge David L. Knox upheld the state's position that its permit became effective when issued. But Eugene Mosely, the attorney who represented Hammond on that issue, said that any challenge to the permit would be useless if Toyota is allowed to build in the Interim. The members of the three-judge panel that heard the case seemed to disagree with that view.

Judge Anthony M. Wilhoit for example, noted that Hammond's suit deals only with environmental damage that may occur once the plant is operating. The review process will be completed by then, be said. If Toyota "wants to build this edifice over here and run the risk that someday a court's going to say you can't operate it they've got that right" be said. A ruling on the air-pollution case is expected within a few days.

Fort Knox soldier's throat cut Youth, 16, gets life in prison for rape and murder of woman By IDRIS ABDUL-GHANI Staff Wrttor FRANKFORT, Ky. Attorneys for union leader Jerry Hammond waged their battle against Toyota Motor new auto-assembly plant on two fronts yesterday. In the morning. Hammond and bis attorneys appeared before Franklin Circuit Judge Ray Corns to argue that a portion of the Incentive package that helped lure the $800 million Toyota factory to Scott County is unconstitutional. And in the afternoon, Hammond's attorneys headed to the Kentucky Court of Appeals to try to halt construction until questions about the validity of the plant's state-issued air-pollution permit are resolved.

Hammond, an official with the Kentucky State Building and Construction Trades Council, Is also a candidate for Congress. He has criticized Toyota's hiring practices In building the plant as well as the overall wisdom of the state's Incentive package to Toyota. The suit challenging the state's giving Toyota 1,600 acres of much-improved farm land valued at approximately $35 million started as a "friendly" lawsuit to test the constitutionality of the plan. The original suit pitted the State Property and Buildings Commission, which is required to issue the bonds that finance the package, against state Budget Director Larry Hayes. Corns later allowed Hammond to join the case as a plaintiff and argue against the deal.

In his oral argument yesterday, Kyle Hubbard, one of Hammond's attorneys, summed up what he viewed as the new atmosphere surrounding the case, saying, "This Is no longer a friendly lawsuit" Hubbard blasted the state for providing land for Toyota, saying the action violates at least seven sections of the Kentucky Constitution. In particular, he said. It violates a provision that prevents the state from making a gift or a donation to an individual corporation. But Spencer Harper, a Louisville bond lawyer who defended the package, asserted that the state isn't Hometown sets memorial service for actor Tom Noel Associated Press FORTVILLE, Ind. He co-wrote musical portrayals of Mark Twain and Jelly Roll Morton and performed them on tour. Survivors include two daughters, a son and two grandchildren. Wednesday. Warsaw driver killed in crash east of Ghent Frem Staff and Special Dispatches GHENT, Ky. A Gallatin County man was killed in a one-car accident Monday night on U.S. 42 just east of Ghent authorities said. Kevin R.

Graham, 28, of Warsaw, died of multiple injuries at the scene, Gallatin County Coroner Jack Lowder said. Kentucky State Police Trooper Jim Mudd said Graham's car ran off the road and traveled 311 feet before hitting a tree. Mudd said Graham, who was alone, was thrown from the car, which burned. Graham, formerly of Carrollton, was a welding instructor at Carroll County Vocational School and a member of St Patrick's Catholic Church in Madison, Ind. A 16-year-old Carroll County youth was arrested early yesterday and charged with murder in the shotgun slaying of Roger Martin, 31, of Route 1, Sanders. Martin died Monday of a single gunshot wound in the chest from a rifle, Kentucky State Police Trooper Jim Mudd said yesterday. A preliminary hearing is scheduled for today in Carroll District Court. The youth is being held without bond in the Boone County Detention Center, Mudd said. Kentucky State Police and Carroll County officials are continuing to the death penalty if the case went to trial.

Under the sentencing arrangement Russell will be kept at a Cabinet for Human Resources institution until he turns 21. He then will be turned over to the Corrections Cabinet for incarceration. If he resists treatment Russell is to be turned over to the Corrections Cabinet immediately. Underscoring the severity of Russell's sentence, Corns ordered quiet in the courtroom while 60 seconds ticked by. "Sixty seconds is a long time.
