Knight Ridder Sews Service The continuing mystery surrounding the death of race-car great Dale Earnhardt has prompted, intense debate among medical and legal experts about how he really died Two months ago, a Daytona Beach, Fla, judge appointed Barry Myers, a Duke University biome-chanical engineer, to study autopsy photos and render an independent report on what lulled Earnhardt Now, some medical and legal experts question Myers' theory that Earnhardt died of a violent whiplash that cracked his skulL And they say the expert's ties to General Motors, sponsor of Earnhardt's No.

3 Chevrolet, impaired his ability to appear independent GM and other car makers have retained Myers as an expert witness to defend lawsuits. Myers declined to be interviewed but said in a written statement he stood by the independence and accuracy of his report GM also said in a statement it is not a party to the debate. NASCAR officials said they are pulling together a panel of international experts to discern the cause of Earnhardt's death. NASCAR president Mike Helton said NASCAR has enlisted outside experts and testing companies that are sworn to secrecy. One testing firm, he said, is recreating the accident using computers.

"You're assuming we're not doing anything because we don't tell you what we're doing," he said. "We have to test things and fail them to find out whaf going oh. We don't want to make a public spectacle of that I don't see anything wrong with being thorough." Although Myers traced Earnhardt's injuries to the extreme peculiarities of high-speed racing, critics of his report said only a blunt impact could have cracked the base of Earnhardt's skulL Joe Burton, former medical examiner for greater Atlanta and a longtime crash investigator, said, "I guarantee you that head- whipping will not cause a basilar skull fracture." Burton and some other experts said Myers' April 10 report dismisses possible safety lapses, such as whether Earnhardt's seat belt broke or was worn too loosely. The report does not provide unequivocal basis for the conclusions that were drawn," said Martha Bedez, a Birmingham, Ala, biomechanical engineer who studies auto crash injuries. Critics of Myers' report also cite other financial ties to GM Besides hiring Myers to testify as an expert witness, GM has financed some of Myers' research at Duke.

The critics say the report's conclusion that natural forces, rather than a mechanical defect accounted for Earnhardt's death deters negative publicity that could hurt General Motors and NASCAR. The court mediator released a resume showing Myers' voluminous record of publications, professional awards and research for the government It did not list the lawsuits in which he had testified. But court documents show Myers has testified for GM at least 12 times as a $200-an-hour defense witness in lawsuits brought by consumers who alleged they were badly injured because of poorly designed cars and faulty seat belts. Myers said in a 1999 deposition that he makes half of his annual income as an expert witness, testifying for the defense in at least 80 of the cases he takes. Also, GM has granted more than $300,000 for research Myers has worked on.

In 1995, he received a three-year, $230,000 grant from GM, administered through tiie National Highway Traffic Safety Administratioa to study neck muscles. "In my opinion that's a clear conflict of interest," said Robert Palmer, a Springfield plaintiffs attorney who has deposed Myers in a lawsuit against a car maker. "He knows that if he displeases GM, he can't continue to testify for them in the future." Owner optimistic despite last-place finish in 2000 By JIM WYATT Sta ff Writer Rowdy Irishman had a chance to do last year what no horse had ever done: Win the Iroquois Steeplechase three years in a row. Instead, the day ended in bitter disappointment, as the highly acclaimed horse finished last in the field of six horses and found itself mired in the middle of a horrible slump. "Having won it twice he sort of raised the bar I think," said Bruce Haynes, the horse's trainer.

"Other trainers did a little more homework maybe and were a little more ready, and Rowdy wasn't quite up to the task last spring. He didn't come out that day like I thought he could or would." In reality, the horse's struggles weren't just confined to that sunny day last May. After winning the 1999 Iroquois race, Rowdy Irishman lost eight straight races and finished no higher than fourth in any of those races. His closest finish was 9 12 lengths behind the winner. But the skid ended two weeks ago in Middleburg, Va, when Rowdy Irishman won the $50,000 Temple Gwathmey Grade II stakes following a stewards' inquiry.

In Rowdy's stable, the optimism has returned. "This spring he's a different horse, for what reason I don't really know," Haynes said. "I haven't done anything different with him. He started coming around last fall." In looking back at past Iroquois events, however, Haynes can't help but think what might have beea "With a little bit of luck he could already have three victories," said Haynes, whose horse won the feature race in both "98 and "99. The horse will try to win his third on Saturday. horse has fared on the course in the past and because of his success on similar courses, Rowdy Irishman should probably be considered as the best long-distance hurdler over the past five years. Jockey Chip Miller, who rode the 12-year-old Rowdy Irishman to victory on his first-ever ride on the horse in Virginia, won't argue that claim. On Saturday, the horse should face plenty of competition, however. All Gong, second in Atlanta and Keeneland recently and winner of the 2000 steeplechase Eclipse Award, is considered one of the we should have won that day.

Then in 97 he fell on the landing side on the next to last jump he was going to be second for sure. "He could have easily already been a three-time winner and once second but as it is he has just won it twice and last year I think that kind of added to the disappointment because I felt like we had a chance to win it for the third year in a row. But I really like his chances this year." The three-mile Iroquois course is best suited for horses like Rowdy Irishman, known more for his strength than his speed. Haynes believes because of the way the other favorites. Rand, owned by Eamon Cleary, is also a highly regarded horse.

"Rowdy Irishman gave me a great feeling in Middleburg a couple of weeks ago and seems to be in great form to me," said Miller, who replaces local jockey Cort Marzullo on the horse for this year's race. "For an older jumping rider to have a chance to get on a horse like Rowdy who's been riding as long as I've been riding is great. He is the sort of horse you keep riding for he's an old, classy veteran who knows exactly what he's doing. Riding him is like having a conversation with a good friend."
