THE TENNESSEAN Thurtday, April 7 1994 Custody fight sent to Williamson Shookhoff: Veach case needs just one judge By KIRK LOGCINS Dorothy Hows Sullivan, and her husband, bail bondsman Garrett Sullivan, live in West Nashville. The two sets of grandparents agreed March 30 to share temporary custody of Elijah, but attorney Susan Brooks, sitting as a special referee in Davidson County Juvenile Court, gave Logan Veach Sr. authority to make medical decisions for the child. The little boy is no longer relying on a respirator to breathe, but he is still listed in critical condition. The elder Veaches say the March 21 crash was an accident, while the Sullivans contend that Logan Veach Jr.

deliberately pulled his Cadillac into the path of his wife's small pickup truck, on Arno-Allisona Road south of Franklin. Betty Ann and Logan Veach Jr. were divorced in 1991, but then remarried. She had said she planned to leave her husband on the day they were killed, her relatives say. Both of the couple's children were riding in Logan Veach car at the time of the wreck.

Nashville. The children's parents, Logan Veach 37, and Betty Ann Veach, 31, lived in Marshall County. But Shookhoff transferred the dispute over custody of Elijah Veach, who is in intensive care at Vanderbilt University Medical Center, to Williamson County. "I want both of these cases to be heard together," Shookhoff said. "You dont want two judges dealing with this family situation Williamson County has the authority to hear this if they want to." Williamson County Juvenile Court Referee Lonnie Hoover awarded temporary custody of Audrey Veach to her paternal grandparents, Mary Ethel and Logan Veach Sr.

of Franklin, soon after the children's parents were killed March 21. But Hoover deferred ruling on who should have custody of 4-month-old Elijah Veach. Hoover said jurisdiction over the little boy might lie in Davidson County, because he is hospitalized here and his maternal grandmother, Staff Writer A single judge should decide the fate of two small children, orphaned by their parents' bizarre head-on car crash with one another in Williamson County, Davidson County Juvenile Court Judge Andy Shookhoff ruled yesterday. Two sets of grandparents are vying for custody of 4-month-old Elijah Veach, who suffered brain damage in the car crash that killed his parents on March 21, and 4-year-old Audrey Nicole Veach, who suffered minor injuries in the wreck. Shookhoff said courts in either Williamson County or Davidson County could claim jurisdiction over the children, since their paternal grandparents live near Franklin and their maternal grandmother and her husband live in Battle Ground Academy sets sights on new campus By SHANNON HEIM Stale Correspondent FRANKLIN With help from alumni, Battle Ground Academy will have a new $5 million campus for the 1996 school year.

"We were driven by the need, desire and the vision for what the school can be," said BGA Headmaster Ronald Griffeth. The new high school, which will house 380 students grades nine-12, will be built on 55 acres west of the intersection of Franklin Road and the Mack Hatcher Parkway. The campus will include a student and arts center, sports fields, a gymnasium and a sports center. will remain at the existing campus in Franklin, built in the early 1900s. Some of the buildings will be remodeled once the upper classes move.

"We will have the luxury of space that we dont have now," Griffeth said. Jimmy French, director of development, said BGA's board of trustees is expected to decide within a couple of weeks on the amount of the initial donation from board members. "From there, hopefully we'll have a good base, and we can go on to what we call a mass appeal," French said. Donations will be requested from alumni and parents of current and past students. "It's more that we saw the opportunity for growth rather than pressure to grow," Griffeth said.

"We dont want to be a huge school. We want to maintain a family atmosphere and continue to give personal attention." The historic Glen Echo home, located on the property, may be used for administration offices. New buildings will likely be designed to "give the appearance of history, heritage and age," Griffeth said. Grades six-eight, including about 240 students, Parents say doctor broke son's leg sive manner," including leaning across the little boy's body to hold his legs down at one point The child could not stand up after the exam, and his right leg began to turn purple, the Pogues said. They said another doctor confirmed two days later that their son's leg had been broken.

Greg Pogue, a sportswriter for the Nashville Banner, and his wife sued Hirshberg for an unspecified amount of damages. Hirshberg declined to comment on the lawsuit when he was contacted yesterday at his home. He said he retired last August after 32 years as a pediatrician. By KIRK LOGGINS Staff Writer A Smyrna couple have charged in a lawsuit that a Nashville pediatrician broke their 18-month-old son's leg during a routine examination last year. Greg and Robin Pogue said they took their son, Clay Joseph Steven Pogue, to Dr.

Charles S. Hirshberg for a "well-baby visit" on April 19, 1993. Hirshberg "did not make any attempt to soothe or calm the child," who was "fussy," the Pogues said in a lawsuit filed Monday in Davidson County Circuit Court.
