While awaiting an October 1978 trial in Cleveland, Shepherd and two other men escaped in July from the Bradley County JaiL The other two were caught within days, but bhepherd was not.

Relatives of Shepherd who live within the county have complained that sheriffs officers harass them in trying to get information about his whereabouts.
