Patton said the tunnel's impact on Kentucky will have historical significance not unlike the impact that the gap had on an emerging nation in the 1700s. Continued from Page One his vote against President Clinton's 1994 crime bill, which included a ban on assault-type weapons, more money for prison construction, expansion of the death penalty and a measure aimed at preventing violence against women. "For the tough crime programs that matter to Kentuckians, Mitch McConnell said no," Beshear said in response to a Courier-Journal questionnaire. McConnell voted for an earlier version of the bill that contained less spending aimed at crime prevention. He says the final version spent $7 billion "on wasteful and duplicative social programs" and funded more social workers than police.

Asked how many social workers, he did not provide a number. He says the ban on assault-style weapons has been ineffective because more than half the weapons listed have been modified to avoid it, and he notes that he voted for the Violence Against Women Act when it was a separate bill. Women seem to be the main target of McConnell's crime ads, which highlight rape and assault. The latest said Beshear ordered police to "publish the names of rape victims," a characterization that could mislead viewers. Beshear issued an attorney general's opinion saying that state law did not allow police to withhold the names, which are rarely if ever published by the news media.

Beshear notes that he supported a 1976 law that protects rape victims, and as attorney general he advocated a law to keep their names secret. He also proposed a host of anti-crime measures, including abolition of McConnell created a minor stir in 1989 when he suggested that the United States should shoot down suspected drug planes that don't respond to warnings. He said this week that he still favors such action, in very narrow circumstances. "When all other tactics and resources have been exhausted, it may be necessary to use force to stop aircraft when there is absolutely no doubt about their illegal activity," he said. "As a rule, these aircraft have been clearly identifiable.

They are flying a few feet off the water in the middle of the night with no lights on." The future Beshear and McConnell agree on some ways to address crime and drugs, and they disagree on others. In some cases, it is a matter of emphasis. To fight drugs, McConnell gives priority to preventing shipments from entering the country. Funding for that work has declined in the past five years, but McConnell notes that the appropriations subcommittee he heads recently provided more money for overseas drug control. Beshear says "drugs must be fought on both the supply and demand level," but he emphasizes prevention, prosecution and treatment, and favors stronger penalties for sell- ing drugs to children or using them to sell drugs.

However, Beshear stops short of endorsing McConnell's bill to give marijuana dealers a minimum 10 years in prison if they are caught with as little as 100 kilograms (about 45 pounds) rather than the current 1,000 kilograms. Beshear says he would fully fund the Safe and Drug-Free Schools Act, which McConnell voted to reduce by almost half last year as part of a package of budget cuts. This year, McConnell voted for an amendment to restore most of the act's funding. Although McConnell's ads appeal to crime victims and a fear of becoming a victim and though he says Beshear "has a record of demonstrating more concern for criminals than the victims of crime," the senator says he is, in fact, undecided about legislation to guarantee victims' rights. Beshear says federal law should guarantee victims the right to be informed, present and heard "at important stages" in a case; a speedy trial; restitution from the offender; and "reasonable protective measures." Both candidates generally favor federal laws that require states to get tougher on criminals such as making them serve 85 percent of their sentence in order to get full fund- ing for prisons and other parts of the criminal-justice system.

To voters who say they're confused about the candidates' stands on crime, McConnell points to his endorsement by the state's Fraternal Order of Police.
