Witnesses said Keith J.

Davis swerved his pickup truck to avoid a car in the parking lot of the restaurant, near Seventh Street and Berry Boulevard, Deputy Coroner Sam Weakley said.yesterday. A door of the truck flew open, and Davis, clinging to the steering wheel, was hanging partially out of the vehicle when the door hit a utility pole. Hoosier kills of estranged Associated Press INDIANAPOLIS Police found 80 to 90 spent shell casings in an apartment where an Indianapolis man fatally shot his estranged wife's boyfriend before turning an AK-47 on himself. For four hours Saturday, Jerry Kelly, 29, peppered an eastside apartment complex with bullets, keeping a SWAT team at bay and forcing residents to the floor in their apartments. Kelly shot James Robert, 35, several times in Robert's apartment, then shot himself, said Sheriff's Department homicide Detective Lt.

Dennis May. "It was just terrifying. Just absolutely terrifying," said Patty Comrie, 54, who lives in an apartment downstairs from Robert. "There was gunshot after gunshot after gunshot." At one point a SWAT team member returned fire but apparently did not hit Kelly, May said. Police say events leading up to the murder-suicide began late Friday when Kelly called his wife and threatened to hurt Robert.

The woman, who is not being identified because she was sexually assaulted during the ordeal, called the Marion County Sheriff's Department and filed a report with deputies, then boyfriend wife, himself went to Robert's apartment. About 5 a.m. Saturday, Kelly broke through the door of the apartment, firing the semiautomatic weapon. So many shots were fired that some deputies thought there was a gunfight between someone hiding in the nearby woods and someone in the apartments, said Sheriff's Deputy Chief Joseph McAtee. "There were bullets ricocheting off trees," McAtee said.

Authorities decided that the gunfire made it too dangerous to evacuate other residents, so they called each apartment and told people to stay away from windows. After Kelly fired at a negotiator, all SWAT team members were told to shoot if they had a target, McAtee said. A short time later, Kelly's wife came to a w'ndow and told deputies he had shot himself. She threw the AK-47 out the window and walked out. Deputies found Kelly's body, with a gunshot in the head, in a back room.

Court records indicated Kelly had not been charged with any violent crimes. In November, he was arrested and charged with residential entry, a felony. In 1995, Kelly was arrested and charged with operating a vehicle while intoxicated. vandalized in November. Perry Cruse of Martinsville said the incident occurred Nov.
