Another death: Field Marshal Lord Harding, who commanded armor at the World War II battle of El Alamein and shrugged off death threats as governor of Cyprus in the 1950s, yesterday at the age of 92. The former chief of the Imperial General Staff died at home in Nether Compton in southwestern England following a long illness, said his son, John. "He will be remembered most of all for his distinguished leadership in the second World War, more especially with the 8th Army (known as the Desert Rats) in the Western Desert," said Alfred Morris, a member of Parliament Harding was appointed governor and commander-in-chief of Cyprus, then a British colony, in 1955, Throughout his two-year tour, he was the target of a "Death to Harding" campaign by guerrillas. A bomb was once found beneath his bed "an occupational hazard," Harding said later. One of his most famous actions was to order the banishment of Archbishop Makarios to the Seychelles.

Makarios was later president of Cyprus, which became independent in 1960. From New York Times and AP Dispatches Beatrice Lillie, who during a half-century theatrical career often was called "the funniest woman in the world," died yesterday at her home in Henley-on-Thames, England. She was 94. Lillie, who used a long cigarette holder to punctuate the barbed ripostes for which she was famous, was the widow of Sir Robert Peel. But she never took her title, Lady Peel, seriously and called her autobiography "Every Other Inch a Lady." The Canadian-born comedian suffered a series of strokes several years ago that silenced her voice and ended her career.

Her last Broadway show was "High Spirits," a 1964 musical version of Sir Noel Coward's "Blithe Spirit" and her last film was the 1966 musical "Thoroughly Modern Millie." The very name Beatrice Lillie could evoke memories of mirth and merriment for the hundreds of thousands of people she entertained in theaters, movie houses, vaudeville palaces and supper clubs and on radio and television, over a period of more than 50 years. In Alexander Woollcott's estimation, Lillie was "a comic genius" with her trademark close-cropped hair and fezlike cap. She was, in fact, one of those rare entertainers whose talents and qualities are extremely difficult to measure and describe. One had to see her to believe her or perhaps disbelieve her. She was a great clown who learned early how to "play" an audience.

LILLIE: "Every other inch a lady" was her self-description. It was often said that no two Lillie performances were the same. She explained that for most of her performances, when things went well, "the wand was on; something happened between myself and the audience, for they recognized something I'd known for years I was a natural-born fool." In her sketches and songs, most of which were constructed to puncture the pompous, Lillie could send her audiences into fits of laughter by merely lifting an eyebrow, twitching her nose or turning her longish face into a rubbery U-shape with a somewhat equine smile. Often it was not precisely what she said or sang that garnered so many laughs, her delivery. As the purchase was a limited waiver of immunity to the extent of coverage $1.5 million In this case and both higher courts agreed.

The suit was brought under the Board of Claims Act as it existed In 1983. The General Assembly amended the law in 1986 to specify that it did not intend the purchase of liability coverage to constitute a waiver of immunity. The Kentucky Constitution bestowed sovereign immunity on the state and counties. The legislature created the Board of Claims to compensate people who could not seek damages in court Justice Charles Leibson wrote the opinion. Chief Justice Robert Stephens, Justices Dan Jack Combs, Donald U'lntersheimer, William Gant and Joseph Lambert concurred.

Justice Roy Vance dissented. In a Grayson County case that also involved the Board of Claims Act before its 1986 amendment the Supreme Court ruled 7-0 that the Health departments' insurers can be liable Home. Although a local health department is immune from liability under the Kentucky Constitution, its insurance carrier can be held liable for damages in the amount of coverage, the Kentucky Supreme Court has ruled. Thursday's 6-1 ruling upheld the reinstatement of a lawsuit in Daviess Circuit Court against Green River District Health Department The department is being sued by a couple who alleged their daughter suffered brain damage at birth in 1983 through the negligence of a department physician. The trial court dismissed the lawsuit by Harold and Mary Wigginton, saying the health department was protected by sovereign immunity. But the Court of Appeals reversed the lower court, noting the department was specifically authorized by statute to buy liability insurance.

law did not extend sovereign immunity to state employees sued in their individual capacities. The ruling came in a suit against two Cabinet for Human Resources employees in Leitchfield Kathleen M. Cann and Kevin Kloubec who allegedly failed to investigate a neglect case that ended in a woman's death in March 1986. They were sued individually by the woman's estate. Thursday's decision reversed a Court of Appeals ruling that the Board of Claims Act was "the sole remedy of a party for negligence against the commonwealth or an employee while acting within the scope of his or her employment." The Court of Appeals also said the 1986 amendment which took effect four months after the woman's death, "clarified" the legislature's Intent to extend sovereign immunity to state employees individually.
