Two Indiana men whose small private plane left Tompkinsville, Wednesday evening were found dead yesterday in wreckage near the Jasper County Airport. Robert Kinsell, 64, of Remington and Roger Kohlhagen, 44, of De-Motte were killed when Kinsell's single-engine Cessna crashed Wednesday night or early yesterday, said Sgt. Pat King, an Indiana State Police spokeswoman.

They had been on a business trip. King said Kohlhagen's wife, Ruth, called a state police detective at home about 11:30 p.m. and said she was concerned because the plane was about 90 minutes late arriving at the airport. Redbook said the best elementary schools usually have a committed principal and nurturing teachers. They emphasize writing and hands-on learning, try new methods of measuring students' learning, make creative use of technology, set high expectations for children, and forge alliances with professionals and artists outside the school, the magazine said. School nominations in the Red-book project came from state school officials, national education organizations, members of Congress and education writers.

Graduate students at Teachers College, Columbia University, winnowed a list of 555 nominated schools to 360 finalists. A panel of 12 education experts then chose the 177 winning schools. Bush said Redbook gave her school a $2,000 award. The money will go for instruction, but Wheeler's participatory management council will decide on the specific use, she said. In January, Wheeler was named a Blue Ribbon School by the U.S.

Department of Education. By MICHAEL JENNINGS Writer Jefferson County's Wheeler Elementary School has appeared on a list of 51 outstanding elementary schools across the country. I Redbook magazine's March issue cites Wheeler, 5410 Cynthia Drive, for its ways of mixing and assessing 'students. The magazine listed one khool in each state and the District pi Columbia under the heading of the states," and Wheeler was named Kentucky's best. Wheeler enrolls about 550 children in kindergarten through fifth grade, but it does not separate students by grade level.

Wheeler principal Charlene Bush said Redbook's description erred in saying the school groups students by ability, a practice commonly called tracking. Tracking "goes against every piece of research that we know," and Wheeler doesn't do it, she said. In all, Redbook honored 177 public elementary schools nationwide as part of its annual "America's Best Schools" project. the schools cited were: for overall excellence, Arlington Elementary in Fayette County, Mary G. MAYFIELD Etolla O'Neal, 66, 'if Laura Miller Deny, a lawyer who gained international attention in the 1940s when she defended a court-martialed soldier, died yesterday at St.

Anthony Medical Center in Louisville of congestive heart failure. She was 87. Deny became the first woman to represent a client before an Army court-martial during the 1944 rape trial of a Fort Knox soldier who faced a possible death sentence. He was acquitted. The trial became a test case and went into Army documents and legal publications throughout the world.

I Deny graduated from the old Jefferson School of Law in 1936 as one of five women in a 126-mem- Derry ber class. She was admitted to practice before the state bar that year. During the first years of her practice. Deny doubled as a history and business-education teacher. She taught during the day and opened her law office after classes ended.

I' In 1937 she was admitted to practice in federal court. She was admitted to practice before the U. S. Court of Military Appeals in 1956 and was believed to be the first Kentucky woman admitted to that UllU llj 11 VII 1JUUI) Kins said. Several people called the sheriffs department to say they might have heard the crash between 8:30 and 9 p.m., said Capt.

Bob Hicks. The wreckage was found about 8:30 a.m. about 1,000 feet west of the north end of the airport's runway. Spokesman Jim Steinkamp said the airport is not staffed at night. The Federal Aviation Administration was expected to send an investigator to the site.

Former OSM director files for bankruptcy Associated Press LEXINGTON, Ky. The former director of the U. S. Office of Surface Mining has filed for bankrupt cy in Lexington. Harry M.

Snyder filed a skeletal Chapter 7 petition March 29 in U. S. Bankruptcy Court. The petition, which allows him to liquidate his assets under court protection, lists 20 creditors but not what they are owed. Under bankruptcy law, that information may be filed separately.

Snyder could not be reached for comment, and his attorney, Jerry Truitt of Lexington, declined to comment. Snyder was selected for the OSM job in 1989. Before that, he was a vice president at CSX, a railroad company. According to financial disclosure forms Snyder filed before he was OSM director, his annual salary in 1989 at CSX was $120,000. He also earned a $36,000 bonus that year from CSX and had other income of at least $15,169 from stock sales, rental property and legal fees.

Snyder's job as director of OSM paid $104,800. A 1991 disclosure report showed he owed $125,000 to $315,000 on three loans. He left his OSM post Jan. 20. Shelby man dies when car runs under trailer A Simpsonville man was killed yesterday morning when his car ran under a tractor-trailer on the Gene Snyder Freeway just south of the Taylorsville Road exit, Jefferson County police said.

Mark A. Richeson, 61, died at about 6:48 a.m. at the scene, Jefferson County Deputy Coroner Robert Carter said. Richard Mikos, 54, of Wills Point, Texas, the driver of the tractor-trailer, was slowing down to stop in the right-hand emergency lane on the westbound Snyder Freeway when Richeson's car ran into the back of the trailer, caught fire and rolled several feet under the trailer, said Officer Wendy Peters, spokeswoman for the Jefferson County police. The Jeffersontown Fire Department put the fire out, Peters said.

Mikos was treated at the scene for hyperventilation. Police are still investigating the accident. Witnesses should call the county police Traffic Office at (502) 425-1020. Richeson was president of Tempo Inc. and a Marine Corps veteran of the Korean War.

Survivors include his wife, the former Mary McHugh; two daughters, Theresa Richeson and Mary Welp, both of Louisville; two sons, William Richeson of Berea and John Richeson of Louisville; his mother, Alice Richeson of Spokane, and three grandchildren. The funeral will be at 9 a.m. tomorrow at Church of the Annunciation in Shelbyville. Visitation at Shannon Funeral Home in Shelbyville will be from 5 to 7 p.m. today.

Sproat and other family members thought Deck killed Kurtz simply because she was tired of caring for him.

Deck insisted from the time of her arrest that she killed her husband at his request. She said she agonized over the decision and the burden her husband's condition put on the family. The degenerative disease, which attacks the nervous system, had robbed the 37-year-old Kurtz of his ability to walk, use his hands or chew. Deny dies; Army case court. She retired in 1990.

Derry compiled and edUed the Digest of Women Lawyers and Judges in 1949, a directory of 6,000 female lawyers and the only work of its kind then. She recently was included in a video project on early female lawyers by University of Louisville law Professor Kathleen Bean. Derry was a native of Horse Cave, a former president of the National Association of Women Lawyers and the Louisville Younger Women's Club, a former treasurer of the Louisville Bar Association, and a former recording secretary of the International Association of Women Lawyers. She had been a member of the American Bar Association, of Women's Club and Louisville Pilot Club. Survivors include a daughter, Portia Derry Brown; two brothers, John R.

and Willie Miller; and two sisters, Clara Miller Cobb and Cattie Lou Miller. The funeral will be at 2 p.m. CDT Sunday at Hawkins-Brooks Funeral Home in Munfordville, with burial in Horse Cave Cemetery in Hart County. Visitation will be from 10 a.m. to 9 p.m.

A former Allen County woman was sentenced yesterday to 20 years in prison in the slaying of her terminally ill husband, a death she insists was a mercy killing.

Rose Deck was arrested in Lincoln, last summer nearly 12 years to the day after her husband died in their Leo, home. It originally was thought that James Kurtz died of Lou Gehrig's disease, but an autopsy after the body was exhumed last summer showed he had been suffocated. Deck, 53, was arrested after her daughter, Janet Sproat, told police she had witnessed the July 10, 1980, killing. Deck claimed her daughter, who was 14 at the time, helped in the killing. Sproat will not be charged, Chief Deputy Prosecutor Fran Gull said.

"We found the allegations to be totally unfounded," he told Allen Superior Court Judge John Surbeck. Sproat, who attended the sentencing, said she watched her mother suffocate her father but never spoke up about it before because Deck had told her she would be implicated. She said she finally went to authorities last summer because she was concerned that the same fate.
