The affidavit said Russell lived in Ohio. Tarr wrote a check for $2,353 for the guns, and each person received a gun, the affidavit said. Kevin McGehee, president of Mark's Guns, said he didn't know if there was any problem with the gun transaction and declined to comment further yesterday. Phil Miller, a spokesman for Attorney General Fred Cowan, would say only that the office was aware Hughes had been under investigation by federal authorities but declined to discuss specifics or explain why Hughes had been rehired.

Hughes was fired June 7 for impersonating a federal drug agent, for improperly using a state vehicle and for improperly taking sick leave all in connection with trips to Cincinnati earlier this year. Hughes appealed his firing to the state Personnel Board, saying the charges were either false or not serious enough to justify the punishment. None of the personnel charges against Hughes mentioned the gun transaction. The attorney general's office tried to amend the personnel charges against Hughes, saying that a state police investigation had led to new "charges of misconduct." A hearing officer refused to allow those additional charges to be used. Sam E.

An employee of the attorney general's office has been questioned in connection with his role in helping an Ohio man buy three guns from a Northern Kentucky store. The employee, Robert C. Hughes, is an investigator with the attorney general's office who was recently rehired and given $11,000 in back pay after being fired for impersonating a federal drug agent.

According to an affidavit filed Aug. 26 in U.S. District Court in Covington, Hughes was questioned by an agent with the federal Bureau of Alcohol, Tobacco and Firearms about the purchase of three pistols at Mark's Guns in Florence. Hughes filled out a federal form when the guns were bought on March 7, but they were paid for by Joseph D. Tarr of Cincinnati, the affidavit said.

Tarr was convicted in Hamilton County, Ohio, in 1957 of assault with intent to rob and served two years in prison, the document said. It said the transaction violated three federal laws that require buyers to live in the state where they buy a gun. The forms are supposed to be filled out by the gun purchaser. Jim Richardson, the agent in charge of ATF's Cincinnati office, said last week that no charges have been filed and that the case was still pending. He declined to discuss the specifics of the case.

Michael Schalk's Associated Press ASHLAND, Ky. The trial of suspended Boyd County school Superintendent Delmis Donta was postponed yesterday for the fourth time, but the judge said there will be no more delays. Special Judge John Gardner of Johnson County put off the trial until next Tuesday after Donta failed to appear to face a misdemeanor charge of second-degree official misconduct. One of Donta's sons, Mike, said his father was scheduled to have surgery next Monday and would likely miss the trial. But Gardner said Donta will be tried next week regardless of whether he shows up in Boyd District Court.

Donta is accused of submitting a false report to the Department of Education saying classes in Boyd County were complying with size limits when they actually were not. The offense carries a penalty of up to 90 days in jail and a fine of up to $250. The day before his trial was to start in May, Donta injured himself pushing a car and had to have hernia surgery. The day before he was to go on trial in August, he collapsed at an Ohio service station, apparently because of high blood pressure. The third postponement was not medically related but was requested by Donta's lawyer.

Donta's sons said yesterday that their father was recovering from surgery at the Ohio State University Medical Center in Columbus. But a hospital spokeswoman who would not give her name said the hospital could find no record of his having been there. Donta, 64, was to have undergone surgery last week to remove a tumor from the back of his head. Mike Donta said after the postponement of the trial that his father was scheduled for surgery on the tumor next Monday in Columbus. He said another operation, to bypass a damaged artery near a kidney, is scheduled for Nov.

14. Mike Donta said his father was staying with a relative in Chilli-cothe, Ohio. In any event, Delmis Donta will have to find a new attorney to represent him. Yesterday Gardner granted John David Preston's third request to be released as Donta's lawyer. Preston convinced the judge that Donta was not helping in his own defense.

"I've had a limited amount of cooperation from my client, and it made it basically impossible for me to provide him with a competent defense," Preston said. Preston said in August that Donta believed people were conspiring to kill him and that Donta believed Preston was part of the conspiracy. Donta was suspended from his job by the state Board for Elementary and Secondary Education this month on unrelated charges of undermining the Kentucky Education Reform Act of 1990. The board has scheduled a hearing for Friday to discuss permanently removing him. Clerk found shot in chest after holdup at convenience store A clerk at a Dairy Mart Convenient Food Mart was shot during a robbery last night, police said.

A customer came into the store at 1351 Bardstown Road around 11 p.m. and heard a moan from behind the counter and "I've been shot. Help me," police said. The customer said he looked behind the counter and saw the clerk, who was on the floor with a bullet wound in the chest, police said. The clerk, whose name was not released, said two men had robbed the store, but he could give little additional information, police said.

He was taken to Humana Hospital-University of Louisville, police said. Details were sketchy about the accident, which occurred late Sunday night. Tom Dorman is one of Wilkinson's closest aides and his liaison with the General Assembly. Abell said the Italian government is required to do an inquest, which may delay the return of the body to the United States for a few days. Abell said the Dormans, who were originally from Louisville but lived in Frankfort, arrived in Rome on Saturday, then went to Florence.

A lawyer for the state Public Service Commission, who is also the wife of a chief adviser to Gov. Wallace Wilkinson, died after a fall during a vacation in Italy, state officials said yesterday. Kathleen Beyer Dorman fell from the second-story hotel room where she and her husband, Tom, were staying in Florence, according to Pat Abell, the governor's general counsel and a friend of the couple.
