THE SALINA JOURNAL Money THURSDAY, JUNE 4, 1998 C3 T COURT CASE Prosecutors seek Exide documents Florida investigating allegations Exide sold defective, used batteries By Bloomberg News BLOOMFIELD HILLS, Mich. — Florida prosecutors asked a state court to force Exide Corp. to turn over subpoenaed documents they want as they investigate allegations that the world's largest auto battery maker misled investors and defrauded consumers. The Florida Attorney General is probing alleged sales of defective auto batteries by Exide and Sears Roebuck and Co. Exide is Sears' primary supplier of batteries. Exide, which manufactures batteries at a Salina, Kan., plant, insists it's been complying with the civil subpoena, issued March 3. Prosecutors claim they've received nothing in response to 20 of 30 categories of requests, however, and they are seeking a court or- der to compel Exide to comply with the subpoena. Assistant Florida Attorney General Lisa Raleigh accused Exide of "willfully refusing to comply " with its subpoena. She's asked a state court to force the battery maker to turn over the documents. Exide said it's produced thousands of documents in response to the subpoena, even though it doesn't think it should have had to. The subpoena seeks 30 categories of documents, including records of all Exide's battery sales in Florida. It also seeks records covering "the sale or delivery of defective or alleged defective batteries to Sears" as well as records of any payments or gifts by Exide to Sears employees. The Florida Attorney General is investigating allegations that Ex- ide sold defective or used batteries, mislabeled batteries, improperly credited customer accounts and misled investors. T KANSAS CORPORATION COMMISSION Competition key to Bell request State's largest local telephone provider wants to get into long-distance business By The Associated Press TOPEKA — Attorneys for AT&T, MCI and other telephone companies tried to build a case Wednesday that Southwestern Bell Telephone Co. isn't making it easy for other companies to compete in providing local service. Southwestern Bell, the state's largest local telephone service provider, wants to get into the long-distance business. But for federal regulators to grant that request, Bell must show that its local markets have been^ opened to competition. Bell is asking the Kansas Corporation Commission, which regulates utilities in the state, to endorse its plan to enter the lucrative long-distance market. Bell needs Federal Communications Commission permission to compete for long-distance service. Regulators in the states in which Bell operates, including Kansas, are being asked to make recommendations to the FCC. The KCC is conducting four days of hearings this week and is expected to render a decision in July at the earliest. "Our application at the FCC is going to be dead if we don't have your firm support," Bill Drexel, an attorney for Bell, told the KCC on Tuesday. "We need to know where you stand." Bell maintains it has done everything required by the law to provide competitors access to its local networks in Kansas. Drexel said the company had finalized interconnection agreements with 39 Kansas competitors. Although most of them aren't offering services yet, Drexel said Bell had done its part by negotiating the access and resale agreements. Competitors offer different view But attorneys tried Wednesday to show that because of computer systems used for customer services, Southwestern Bell was not making it easy for competitors to use its network. They tried to show that competitors did not have the same access to the system as Bell; competitors were forced to use more cumbersome procedures, and more orders for competitors were falling through the cracks than for Bell. Under questioning by AT&T attorney Kathleen LaValle, it was revealed that some local carriers were reporting a "deterioration of support" by Bell to Bell's systems consultant, Coopers & Lybrandt. Other testimony showed that Bell considers Valu-Line, which resells Bell features in providing local service across Kansas, a wholesale customer. But Bell charges Valu- Line higher retail prices. Drexel said Tuesday that about 46,000 access lines once served by Bell are now being served by other local telephone companies. Two companies, Birch Telecom Inc. and Feist Long Distance Service, are competing with Bell for local customers in Topeka. Valu-Line is a division of Birch. Bell's competitors contend the local telephone giant hasn't lost any market share, insisting the company has actually experienced a net gain in access lines due mainly to increased demand for Internet connections. "Before Southwestern Bell can be permitted into the long-distance market, serious work needs to be done," said LaValle. "There is work that remains to be done to open the local markets in Kansas to competition." The company last month paid as much as $1.7 million for its first- ever national television advertisement on the finale of NBC's "Seinfeld," one of network TV's top-rated shows. The Portland, Ore., company said the results are rolling in: In the week after the ad, sales rose fivefold and the company's Gar- denburger brand patties — avail- able in such flavors as fire-roasted vegetable, zesty bean and savory mushroom — now are No.l in U.S. grocery stores. It was No. 2 before. "Our advertising is driving the veggie patty category to record levels," said Gardenburger Chief Executive and President Lyle Hubbard. Veggie burgers now are so hot that the company sold more patties in the week following the final "Seinfeld" episode than the entire frozen meatless-burger industry in the previous year. The company's seven-week ad campaign, which started May 4 and ends June 21, consists of about 1,500 TV spots.
