Legal Notices Officials oardProceedings NOTICE OF HEARING AND LETTING NOTICE OF PUBLIC HEARING ON PROPOSED PLANS AND SPECIFICATIONS AND PROPOSED FORM OF CONTRACT FOR THE CONSTRUCTION OF LAGOON REPAIRS FOR THE MUNICIPALITY OF TEMPLETON, IOWA OF IMPROVEMENTS AND EXTENSIONS THERETO, AND THE TAKING OF BIDS FOR SUCH CONSTRUCTION Notice is hereby given that the Council, of the Municipality of Templeton In Carroll County, Iowa, will meet at the City Hall In said Municipality, on the 3rd day of May, 1976, at 7:30 o'clock P.M., C.D:S.Tv, at which time and place or at such later time and place as the Council may then fix, a hearing will be held and said Council proposes to adopt plans and specifications and form of contract and to receive bids for the construction of lagoon repairs In and for said Municipality or Improvements and extensions thereto. The extent of the work involved consists of the construction of earthwork, raising structures and, adding rock, together with related subsidiary and Incidental work. The kinds and approximate quanities of materials and types of construction for which bids will be received shall be as follows: Remove silt from Northcell lump sum Earthwork 11.923 c.y. Raise Inlet manhole lump sum Raise Outlet manhole lump sum Raise valve box &' extend wrench lump sum Remove & replace fence lump sum Rock road i. Dikes lump sum Sterilize Floor of North Cell , lump sum Seed Area Disturbed lump sum Rip raptor stream bank protection 350 tons Flow Recording Device Proposals received will be acted upon by the Council at the time and place above specified or at such later time and place as.may then be fixed. All work materials are to be In strict compliance with plans and specifications prepared by Garden & Associates", Ltd of-Oskaloosa, Iowa, which together with the proposed form of. contract have heretofore been approved by the Council, and are now on file for public examination in the office of the Clerk, and are by this reference made a part hereof as though fully set uut and incorporated herein. All proposals and bids In connection therewith.shall be submitted to the Clerk on or 1 before the t.lme herein set for hearing and letting. All proposals shall be made on official proposal forms furnished by the Municipality or the Engineers, and must be enclosed in a separate sealed envelope and plainly Identified and addressed to Clerk, Tern- pleton, Iowa. Each proposal shall be accompanied by a bid bond or certified check in a separate sealed envelope in an amount equal to ten percent (10%) of the total amount of (he proposal. If bid bond Is submitted, it must be on the form provided with the Contract Documents. The certified check shall be drawn on and certified to by a responsible bank (for sewer projects the certified check must be drawn on and certified to by a responsible-bank in Iowa), and payable to the Treasurer rjti of the Municipality as security that if awarded a contract by resolution of said Council, the Bidder will enter Into a contract at the prices bid and , furnish the required performance and payment bond and certificate of insurance. The certified check may be cashed, or the bid bond forfeited, and the proceeds retained as agreed liquidated damages If the Bidder fails to execute a contract or file an acceptable performance and payment bond or /provide a certificate of insurance on form provided In the specifications within' ten (10) days after the acceptance of his proposal by resolution of the Council. No bidder may withdraw a proposal within ninety (90) days after the date set tor opening'bids: At the said hearing the Council will consider the plans and specifications and proposed form of contract for the project, the same now being on fi|e in the office of the Chirk, reference to which is made for a more detailed and complete description of' the proposed work, and at said time and place the said Council will also receive and consider any objections to said plans, specifications and (orm of contract or cost of such project made by any Interested party. Payment of the cost of said project will be made In cash to be derived from the proceeds of the sale of revenue bonds, which said bonds will be payable solely and only out of the future net earnings of the municipal sewer system and/or from such other cash funds on hand as may be lawfully used for said purpose and /or from the proceeds of a federal and/or state grant or grants as may be obtained. Payment to each Contractor will be made in monthly estimates and one final payment. Monthly estimates will be equivalent to ninety percent (90%) of the contract value of the work completed during the proceeding calendar month. Estimates will be prepared on the first day of each month by the Contractor, subject to the approval of the Engineer, who will certify each approved estimate to the Council for payment on or before the 15th day of the month In question. Such monthly payments shall in no way be construed as an act of acceptance for any part of the work partially or totally completed. Final payment to each Contractor 'will be made ~no earlier than thirty-one (31) days from and after the final acceptance of said work by the Council, subject to the conditions and In accordance with the provisions of Chapter 573 of the Code of Iowa. No such partial or final payment will be due until the Contractor has certified, that the materials, labor and services involved in each Instance have been paid for In accordance with the requirements stated In the specifications. The work under the contract for each section shall commence on or before the date specified in a written "Notice to Proceed" and shall be fully completed and ready for operation within 120 consecutive calendar days thereafter. By virtue of statutory authority preference will be given to products and provisions grown and coal produced within the State of Iowa and to Iowa domestic labor to the extent lawfully required under Iowa statutes providing that the award of the contract will be made to the lowest responsible bidder submitting the lowest acceptable bid, which shall be without regard to State or local law whereby preference is given on factors other than the amount of the bid. Contractors may bid on any or all sections. However, the Council will award a separate contract for each section, and no tied bids will be permitted. "Bidder's Propsals," plans and' specifications may be obtained from the Engineer: A deposit of $25.00 will- be required for the plans and specifications, $10.00 of which will be refunded to those returning them In good condition within twenty (20) days after the date of the bid opening 1 . Each successful Bidder will be required to furnish a performance and payment bond on an approved form In an amount equal to one hundred percent (100%) of the contract price, said bond to be Issued by a responsible surety approved by the Council, and shall guarantee the faithful performance of the contract and terms and conditions therein contained and shall guarantee the prompt payment of all materials and labor and protect and save harmless the Municipality from claims and damages of any kind caused by the operation of the Contractor, and shall also guarantee the maintenance in good repair of all work and materials for a period of two (2) years for a sanitary sewer project ' from and after the completion and acceptance of the work by resolution of the Council. Labor Standards Contract Provisions and Federal Wage Determinations are also applicable to work performed under this contract. Said requirements are explained in the specifications. Bidders on this work wijl be required to comply with Presidential Executive Order No. 1124.6.. Interim financing has been arranged for the treatment facilities contract which is that portion of the financing assistance being obtained from the Environmental Protection Agency (EPA) and any Iowa State grants. Under this arrangement the town can pay the contractor in cash received in anticipation of receipt of said EPA and State grants. Any contract or contracts awarded under this Invitation for Bids are expected to be funded in part by a grant from the United States environmental Protection Agency. Neither the United States nor any of its departments, agencies or employees is or Will be a party to this Invitation for Bids or any resulting i contract. The Board of Supervisors approved the request of Bernice Williams, County Treasurer, that Mary Lou Seidl be hired on full-time instead of part-time. The Salary was set at $380.00 per month effective April 1,1976. The Carroll County Association of Independent Insurance Agents notified the Board of Supervisors that as of June 1, 1976, the General Liability and Workmen's Compensation coverage will be cancelled.
